(Manchester, NH) (March 9, 2016)

Dear American:

This will be my fifteenth letter to the American people from the 2016 campaign trail (# 14 is still in progress). First a quick apology, then a look back, then finally a “contrarian” analysis that the liberal media ignore but that common sense Americans readily understand.

I have been working on a critique of Donald Trump’s campaign approach. I congratulate him for a great Tuesday night victory but my comments are still valid and will appear in a few days. As I was preparing a first draft of the Trump story Sunday night I wanted to append a short paragraph at the end stating my prediction that Bernie Sanders would “overperform” Tuesday night (yesterday).

I have not finished the Trump story so the Sanders prediction did not go out, but trust me I had planned to make my very bold call on Michigan.

My little “boutique” presidential campaign is under-resourced and we are working on the rollout of a major campaign initiative next week. So I am a little backlogged in getting stories out.

As I write this letter the Michigan primary has just been called for Bernie, which is both a major political upset and also upsets the future course of the 2016 presidential election.

Amazingly, no one will tell you why Sanders won Michigan. I will.

Yes, Hillary is a lousy campaigner. And, yes, Bernie is against trade agreements, etc. But those issues were not the critical factor Tuesday.

The decisive issue that turned Michigan around could turn the entire Democratic Party primary campaign upside down as Sanders goes into Ohio, Pennsylvania, Wisconsin, Illinois and other Middle American states.

The issue is guns.

I watched the Sunday night debate when Clinton started exploiting the terrible shooting tragedy in Newtown, Connecticut several years ago. The killings were a horrible event. Unspeakably tragic. But why was Clinton tear-jerking? And why punish the gun manufacturers with frivolous lawsuits because of the actions of a crazed killer?

Clinton, of course, thought she was being cute by beating up on poor, old Bernie on gun control. But she was actually shooting herself in the foot, again. They say Clinton is “so smart.” I wonder.

The guns used by the crazed killer in Newtown were lawfully purchased by the killer’s mom. She left them in an open and unlocked gun cabinet. She knew her son was mentally ill (but did she actually admit it to herself?).

Why would a manufacturer of the Newtown guns be liable for damages because it produced a legal product, sold it to a legal buyer and the legal buyer then left the product sitting around for a criminal to misuse?

This is not the first time I have predicted Clinton’s abuse of the Second Amendment would boomerang in Bernie’s favor. I made that prediction before the Iowa caucuses, and I was both right (see link below) and slightly wrong. Surprisingly, Bernie almost won Iowa, though I predicted a win. And I underestimated the power of the African-American vote in later Southern primaries. But my underlying premise was 100% correct: by attacking Sanders in Iowa as “pro-gun,” Clinton had “shot herself in the foot” and handed Sanders an unexpected gift. Read my earlier story.

Sunday night she made matters even worse (see links below).

Clinton staked out the most radical anti-gun position in presidential campaign history. Clinton claims that if someone buys a legal product, a gun, but that firearm is later misused by a non-purchaser or even the lawful purchaser, the manufacturer should be liable for the injuries caused by the crime. Clinton also demands that only “safe guns” be sold. No gun is “safe” in the hands of a maniac or criminal.

Of course, this week the liberal term “dog whistle” really applies. Monday the NRA tweeted an endorsement of Sanders’ Sunday night point of view (see link below) which opposed Clinton’s radical proposal. One liberal (at Salon.com, see link below) said the NRA tweet would hurt Sanders. On the contrary, Sanders’ principled position just won Bernie an election. That explains how far the liberal (Salon.com) media are divorced from understanding everyday Americans.

Clinton’s “extreme” (even the word “extreme” does not go far enough) position on gun control dooms the Democrats in November.

Gun control has been a Democratic Party graveyard since 2000.

This year, Democrats thought they could revive gun control as a winning issue. Sanders’ victory in Michigan shows that belief is a pipe dream.

Surprise! Millions of Democrats own guns. Although Bernie is derided as a socialist dreamer, he is actually a practical politician. He wins elections in Vermont, a state that essentially has no local gun control laws (other than applicable federal statutes). So if Vermont has no gun control laws, why is the state not a dangerous shooting gallery? Because law-abiding Vermonters do not abuse or misuse guns. To be sure, Bernie is no pro-gun “nut.” He still gets a “D” from the NRA. But Bernie has courageously been defending common sense on guns during the Democratic primary debates, while Clinton has shamelessly demagogued the Second Amendment.

Where are rural and small town and suburban Democrats going to buy guns when all of the manufacturers are put out of business by the liberals’ trial lawyers’ lobby? Guns will eventually disappear if their manufacturers are forced to disappear. The Second Amendment would ultimately be eviscerated under Clinton.

People are not stupid. People in Michigan (yes, Democrats!!!) own guns. In Ohio. In Pennsylvania. In Wisconsin. Of course they do. We are pluralistic society where residents of small towns and rural areas can own guns and still hold liberal positions on social or economic issues.

What about “safe” guns? Well, safe guns are a question of money. I suppose we could manufacture a foolproof gun, but it could cost more, a lot more. And who would decide what was a safe gun and what was an unsafe one? Obviously, Washington bureaucrats would regulate the manufacturing of firearms. Under Clinton they would be in control.

To repeat, it is not inexpensive guns, or even simple guns, that cause crimes. It is criminals. Liberals seem unable to face that reality. That’s why we have a Second Amendment to protect gun ownership, and why the views of the new justice who replaces Justice Scalia on the U. S. Supreme Court are so critical.

Right now I can’t predict how the Republican “establishment” and Donald Trump will come to terms if he wins the nomination (but they will). My critical article on Trump is still in the works. And my major new campaign issue is still coming next week.

But I can predict with 100% certainty that Hillary Clinton just upended herself in upcoming Midwest primaries. Even if she wins her party’s nomination, her stand on gun manufacturer liability will doom her chances in November. You heard it first here.

Sincerely yours,

Andy

BULLETIN: Beginning Saturday morning Andy will temporarily be in his South Florida war room to observe and comment on the Florida primary

(New York, NY) (March 12, 2016)

Dear American:

This will be my sixteenth letter to the American people from the 2016 campaign trail (# 14 is still in progress). Friday night I was in New York en route to our South Florida war room Saturday for the Florida primary on Tuesday. I turned on the TV and saw the anarchy in Chicago.

Make no mistake: the rioters in Chicago, and the liberal news media that are encouraging and enabling them, are “Obama’s children.” Loyal Americans must fight back against this anti-American “army.”

For the past seven years Democrats - Obama, Clinton and Sanders - have been energizing a grievance industry targeting African-Americans, Latinos and Muslims. They have falsely portrayed African-Americans and Latinos as victims of “mass incarceration” and other imaginary maladies. Friday night, African-Americans, Latinos and Muslims came together to riot in Chicago at the University of Illinois to prevent Donald Trump from holding a lawful political rally.

Chicago is now officially “ungoverned” and very possibly ungovernable territory. What a disgrace to a great city.

The latest anarchy is being energized by the liberal news media that is endlessly propagating lies and false legal doctrines.

Allow me clarify two legal doctrines for you:

First, the “right to protest” is not absolute. If someone rents an event space, such as a large hall or ballroom or even a stadium, that person or organization is entitled to use that space without “protesters” infiltrating the space and trying to disrupt the event. No one has a right to go into an event being conducted by someone - a campaign, business or other organization - and disrupt that group’s event. Such disruption is a criminal act. The so-called Black Lives Matter anarchists that are deliberately disrupting Trump events are committing criminal acts and they must now be prosecuted by local authorities. Why did the Chicago Police not make any arrests?

When the media falsely claim that “Black Lives Matter” terrorists have a “right” to go into as Trump event and protest, the media is totally wrong. No such right exists.

Second, there is a broad constitutional right to protest peacefully OUTSIDE an event, within carefully delineated areas established to maintain public safety. People can line up outside, make noise, and act obnoxious; they have an absolute constitutional right to act in that manner OUTSIDE the event.

Society, i.e. law enforcement, has a constitutional obligation to protect free speech. That duty is called the duty to prevent a “heckler’s veto:” https://en.wikipedia.org/wiki/Heckler%27s_veto

While the Chicago Police did not officially cancel the Trump event, authorities obviously warned Trump representatives that the event space had become corrupted with thousands of violent protesters and that the police were unable to control the crowd. Trump was essentially forced to cancel his rally because the Chicago Police lost control of the situation.

Obama has been energizing minorities for seven years; he has led them to believe they are victims and have a laundry list of grievances. Hillary Clinton and Bernie Sanders have picked up where Obama is leaving off. Many of the rioters Friday evening were chanting support for Sanders.

What does the Chicago riot mean:

1. Seemingly senile commentators such as David Gergen on CNN that are anti-Trump are trying to blame Trump for Obama’s rioters. Gergen has the matter backwards.

2. The Democratic Party realizes they can't stop Republicans in 2016, so they are trying to violently shut down the Republican Party’s campaign. Trump is a symbol, not a cause, of the rioters’ agenda. Expect massive Democratic Party-sponsored anarchy at the Republican National Convention in Cleveland.

3. Hillary Clinton and Obama are practitioners of “rules for radicals” authored by Saul Alinsky in Chicago. Clinton (and Sanders) are trying to radicalize the Democratic Party politic to prevent Republicans from peacefully assembling, and trying to intimidate Republicans from speaking their minds on crucial issues facing the nation. Sanders admits he is a “revolutionary.” “Peaceful revolutions” usually morph into violent ones. Friday night was a down payment on the Sanders agenda. Now we know who Bernie’s real supporters are.

4. Donald Trump does not owe anyone an apology. Inside his own events, Trump is entitled to engage in colorful speech, hyperbole, boisterousness and exaggeration. That is the essence of political speech. Outside protesters cannot intentionally infiltrate Trump events and then try to make Trump self-censor himself under the threat of disruption. The gentleman who hit a protester who was being evicted, however, was absolutely wrong. Trump has no obligation to warn his supporters to be peaceful. They are peacefully assembling to hear him. The outside agitators are causing the disruption. They are the ones who should be condemned. They are knowingly and intentionally committing criminal acts.

5. Although the media have tried to link Trump with Hitler, Friday night we saw where the real neo-Nazis, and brown shirted storm troopers are centered: smack in the middle of the Democratic Party’s supporters.

6. I did not hear any chants for Hillary at the riot, but there were loud chants for Bernie. If anyone owes the American people an apology, it is not Donald Trump. Rather, Bernie Sanders owes Americans and Trump an apology because his supporters engaged in neo-Nazi tactics trying to censor a political speech.

7. I landed in Chicago from Viet-Nam on the day that the 1968 Democratic National Convention began. I witnessed all of the chaos that was to follow. Ultimately, unlike David Gergen’s nonsense that real Americans are going to become afraid of Trump because of the Black Lives Matter demonstrators, history clearly teaches that real Americans are going to be afraid of anarchy in the streets and what a Clinton or Sanders administration could mean. Americans will join Trump, not the Democratic Party’s demonstrators.

8. In 1968, the riots in Chicago backfired on the Democrats. I can predict without fear of contradiction that the Obama-Clinton-Sanders riots in Chicago Friday night are going to backfire and boomerang on the Democrats. The Democrats need to call off their brown shirts and storm troopers if they want to have a chance of winning in November.

9. Donald Trump and the Republican Party do not owe anyone in Chicago, or anywhere else where their political meetings are being intentionally disrupted by “outside agitators,” any apology. The assemblage of “Black Lives Matter” thugs, Sanders supporters and Democratic Party hooligans are on the verge of becoming an organized interstate criminal enterprise that must be crushed by federal and state law enforcement to ensure the integrity of the 2016 presidential election.

Saturday you can reach me in, or read me from our war room in South Florida.

Sincerely yours,

Andy

(San Francisco, CA) (November 23, 2015) Republican presidential candidate Andy Martin launched his West Coast campaign efforts Sunday when “Andy’s Army” landed in San Francisco yesterday and set up a temporary campaign headquarters at a luxury three-room hotel suite on Nob Hill. “Andy is not a Donald Trump ‘wannabe,” says Linda Smith, “but he may be the GOP presidential race’s Trump mini-me. Pollsters should add Andy’s name to their lists.”

“Andy has been a major factor in two of the last four presidential races. In 2000 he helped knock out George W. Bush in the New Hampshire primary when Andy broadcast a devastating TV ad that predicted (in 1999-2000) that George W. Bush wanted to launch a war against Iraq.

“In 2005-2008 Andy exposed Barack Obama as a fraud, costing Obama millions of votes in the process. The anti-Obama movement, which Andy fathered, continues to grow in force throughout American politics and today forms the backbone of Donald Trump’s campaign.”

After arriving in San Francisco on Sunday Andy attended services at Grace Cathedral (Episcopal) on Nob Hill.

The candidate did not attend the memorial to Carol Doda, but while in San Francisco he will be writing a column about the Bay Area’s impact on modern American culture.

“As someone who has been an urban educator, and is comfortable in metropolitan areas from coast to coast, I am a Republican who can speak to and work with America’s cities,” Andy says. “I do not expect to win the presidential nomination, but I do expect to be a factor and to provide an opportunity for the party to ‘open itself up’ to voters who currently feel disenfranchised.

“The ‘anti’ voters in both parties (Trump, Carson, Sanders) have more in common than they have that divides them.

“But I am also here to deliver a stern message to California: rejoin America and respect our laws or pay a heavy price when California some day needs assistance from the rest of the country.”

Andy is ramping up his West Coast campaign after qualifying in the first-in-the-nation New Hampshire primary, where he has challenged the ballot eligibility of Bernie Sanders. Andy will participate, from San Francisco by telephone, in a Tuesday hearing (which may be continued) at the Legislative Office Building in Concord, NH. “I believe the New Hampshire hearing should be rescheduled to next week and I have asked the NH Supreme Court to take action. But if technology permits, I will be ready to start the proceedings from San Francisco on Tuesday to remove Bernie Sanders from the New Hampshire Ballot,” Andy notes.

Andy can be reached directed in San Francisco through the Mark Hopkins Hotel, (415) 392-3434, Suite 1438.

Andy is expected to have a news conference later today at his campaign headquarters. Details to follow.

Ms. Kristina McNamara
Paralegal
Bernstein Shur
Manchester, NY
by email: kmcnamara@bernsteinshur.com

Dear Ms. McNamara:

This morning I received your law firm’s response to challenge to Bernie Sanders.

The Ballot Law Commission hearing is proceeding in a chaotic and disorganized manner and I am asking for an adjournment so we may have time to organize a properly-structured hearing.

However, in the absence of any management or leadership by the chairman, I will try to narrow the issues with your firm based on a very brief perusal of your document. Your firm’s document is over seventy (70) pages long and I have not had an opportunity to review it in detail. I do find several facial defects in the document, and also some unanswered questions.

As someone with over forty (40) years of experience in election law litigation I am surprised by the lack of professionalism and proper practice (pre-filing due diligence) manifested in the claims submitted on behalf of Senator Sanders. I would have expected a better-researched and more coherent submission on behalf of Sanders given the tens of millions of dollars at his disposal.

Also, because of the fact that I am preparing to file a court challenge to the hearing, I would like to make a record that I have made a good faith effort to narrow the legal and factual disputes before the Commission, before going to court, particularly since the court challenge will be filed momentarily.

I would appreciate it if you would turn this memo over to the attorney handing the file so we can either conference on the phone or respond to each other in writing.

Without waiving any claims or defenses as to timeliness of your client’s reply I am willing to accept an amended filing from your office later today if you care to make the changes I have requested below.

1. Request that you withdraw claim/issue - Secretary “approval”

You claim the Secretary of State (“Secretary”) has “approved” Mr. Sanders’ filing. The Secretary in no way, shape or form approves the factual or legal substance of a candidate filing.

The Secretary merely reviews a candidate’s Declaration of Candidacy for acceptance and filing. Your apparent claim that the Secretary has somehow “approved” Sanders’ claim that he is a Democrat is therefore unprofessional (an effort to falsely attribute action to the Secretary which he has not taken) and factually and legally erroneous as a matter of New Hampshire law.

If you refuse to withdraw this claim and refuse to file an amended objection with that claim about the Secretary being withdrawn, I am going to have to ask that the Secretary be subpoenaed to testify to falsity of your argument and to establish that the Secretary has in no way shape or form “approved” the legal or factual substance of Mr. Sander’s candidacy. The Secretary has approved the form of Sander’s filing form just as he has done the same for me.

2. Request that you withdraw claim/issue - Secretary “my registration”

One of the reasons I have accused your law firm of filing a sloppy response with the Commission is that I have been a registered voter in New Hampshire for many years. Last year I was a candidate for the United States Senate from New Hampshire. Obviously, your firm made no pre-filing inquiry as to my voter registration and merely submitted my statement of presidential candidacy advising the Federal Election Commission where to send mail. I equally obviously do not live in a post office box. Moreover, all of my mail to the Ballot Law Commission, which has been copied to your law firm, lists a “national headquarters” in New York. People do not usually live at a national headquarters.

Above in this letter I accused your law firm of professional incompetence, probably bordering on malpractice. Your claim that I am not a registered voter in New Hampshire is embarrassing to both to your firm and to Sanders. The Declaration of Candidacy I filed with the Secretary (the same form submitted by Sanders) identifies my domicile as 144 W. Webster Street, Manchester, New Hampshire. A simple call to the city clerk would have confirmed my voter registration. For your law firm to make the wild accusation I am not a registered voter in New Hampshire without even checking my own Declaration of Candidacy to see where I declared my domicile, is utterly incompetent and unprofessional.

If I had made the same mistake your firm would be highly critical of my professional competence. Attorney due diligence calls for examining the basic file in a case, not making wild and unsupported accusations without any research and, without in this case, even looking at my own Declaration of Candidacy.

I ask that you withdraw your outrageous claim I am not a voter because it only makes your attorney and your law firm look like bush league incompetents and jokers; that is not the image genuine Granite Staters want to project to the world (my family arrived in New Hampshire 100 years ago). If you refuse to amend your filing to remove your false and fraudulent claim I will have to subpoena the city clerk from Manchester to confirm my voter registration.

3. Request that you withdraw claim/issue - Secretary “standing”

Now that we have established that your law firm (and apparently paralegals as well) did not even check my own Declaration of Candidacy on file with the Secretary in Concord, we can move to the next incompetent argument you make, one that is undermined by claims made by one of parties whose documents you submit.

You claim I do not have standing because I am not a Democrat. Under New Hampshire law that is another outrageously incompetent and unprofessional argument.

First, because under New Hampshire law an unaffiliated voter can choose to vote in either primary, the list of candidates in one primary can directly affect the voter turnout in the other party’s primary. This reality has been written about and remarked about in the media for decades and decades.

Second, I am not aware that in many years of candidate challenges the New Hampshire Supreme Court has ever claimed that only the voter of the same party can challenge false filings by a candidate in that party. Uniform practice in New Hampshire history shows the contrary. If you have case law to support your claim, please provide it. Otherwise, as Bernie would say, “Stop with the nonsense!”

Third, and perhaps most embarrassingly for your law firm and client, the New Hampshire Democratic Party routinely challenges Republicans. Obviously, the very same people who are participating in and supporting your client’s sham candidacy in New Hampshire as a Democrat take a contrary view of the law in their own conduct. Take a look at the following link and see if I am right:

http://nhdp.org/blog/2014/06/23/nhdp-files-reply-to-walt-havensteins-petition-with-ballot-law-commission-underscoring-unanswered-questions-about-havensteins-eligibility-and-tax-issues/

The New Hampshire Democratic Party challenged a Republican just two years ago. Were they Republicans? Obviously not. That makes your contrary argument that only a Democrat can challenge Sanders incompetent and unprofessional. I therefore urge you to withdraw your unprofessional and legally humiliating claim that only members of a party (I am a registered Republican) can challenge filings of their own party with the Secretary, and file an amended response to my objection. The link above conclusively shows that your argument is absurd and makes both your law firm and candidate look desperate for a defense. I urge your law firm not to insult the intelligence of either the voters of New Hampshire or the New Hampshire courts.

4. What is the only issue?

I would urge counsel to stipulate with me that the only issue is whether Sanders is a bona fide Democrat and legally qualified to claim he is a Democrat when he simultaneously claims to the contrary in his own official publications. Ironically, that is my only claim, and that is the only claim your response did not respond to! Why don't we strip away all of your distracting nonsense (which is perhaps why you are filing all of this extraneous drivel in the first place) and cut to the core, so we do not waste time? I have a legitimate argument and if you respect that fact you will gain respect from the Commission. If you embarrass the Commission by making stupid arguments you will only make your law firm look incompetent and unprofessional and make me look good, which is clearly not your objective.

5. My unopposed motions

I have filed several motions with the Commission, seeking to recuse the chairman and seeking an adjournment or renewed hearing date for the grounds stated therein, to the week of November 30th. Although I did not know your firm was representing Sanders until yesterday, I have been serving the firm because I erroneously believed a member of the firm was a member of the Commission, so your firm has had notice of everything I have filed. Most respectfully I would ask that counsel promptly advise me, so that I can advise the court, whether your office opposes those motions or not, including the motion seeking the issuance of a subpoena for your client. If I o not hear from you promptly, I will also have to move for subpoenas for the Manchester City Clerk (voter registration) register as well as the Secretary himself (claim of “approval”).

With counsel’s response to the foregoing inquiries and requests, we can start to narrow the factual and legal issues and attempt to conduct a rational proceeding narrowly focused on the single substantial issue, instead of your firm’s filing a hodgepodge  of ridiculous claims and attempting a scatter shot defense that will make a hearing unnecessarily long and embarrassing to the state and Commission.

If the Commission will not try to conduct a rational and properly structured hearing with adequate opportunity to prepare, at least the lawyers can attempt to do so. I am doing so with this letter.

Please feel free to have counsel call my national toll-free number that will reach me anywhere in the nation and is forwarded to my cell phone for immediate response.

Respectfully submitted,

Andy Martin, J.D.

FOR IMMEDIATE RELEASE: November 18, 2015

Andy Martin: “We are working on two closely related scandals involving Bernie Sanders and my challenge at the Ballot Law Commission to the legality of Bernie’s status on the 2016 presidential primary ballot. One scandal looks very solid, and may prove a major embarrassment to New Hampshire state government. We are still investigating the second scandal. We hope to be able to start disclosing these scandals on Thursday and Friday, November 19-20, with the possibility of filing an emergency court petition.”

FOR IMMEDIATE RELEASE: November 18, 2015

Andy Martin has asked the New Hampshire State Ballot Law Commission to issue a subpoena for Senator Bernie Sanders. Andy is trying to reschedule the currently-scheduled hearing but is willing to appear by phone if necessary on November 24th. He suggests an appeal to the New Hampshire Supreme Court is very likely. After being unable to reschedule his prior commitments Andy will be campaigning in California on November 24th.

WATCH FOR: How an obscure New Hampshire pop-up state agency is about to make political history. Andy will provide his insight into the significance of his challenge to Bernie Sanders.
