(CHICAGO) (April 19, 2012) Republican Presidential candidate, New Hampshire corruption-fighter and conservative blogger Andy Martin won a landmark court victory in the New Hampshire Superior Court when Justice Larry M. Smuckler ruled in Andy’s favor and forced the New Hampshire Attorney General Michael Delaney to release files concerning the sale of Tillotson Trust property which Delaney was fighting to keep secret.

Andy is based in Chicago and New York (see bio below) and now maintains a public service office in New Hampshire.

“During the course of the presidential primary campaign and in my final message to New Hampshire citizens (the video is available on my web site, see above) I promised New Hampshire residents I would not abandon my public service efforts on their behalf after the primary.

“I conducted a Superior Court hearing on January 18^th, and Justice Smuckler thereafter ruled in my favor concerning the release of documents involving the sale of The Balsams. (Justice Smuckler also ruled financial reports were subject to an exemption, and that statutory exemption concerns me.)

“I continue to believe the Tillotson Trust is being corrupted and mismanaged to benefit insiders and in violation of the intent of Mr. Tillotson who created the Trust. I am also convinced the New Hampshire Attorney General is failing to properly administer and supervise the Charitable Trust Unit and has engaged in fraudulent and corrupt official conduct.

“Nevertheless, I won a landmark victory when Justice Smuckler ruled that the secret files concerning the purported ‘sale’ of the landmark hotel, The Balsams, must be disclosed. I have received those documents and they are being reviewed by my office. The Attorney General had tried to bar me from examining The Balsams sale records.

“My political activity is based on a 46 year record of public service and public integrity. I made promises in New Hampshire and I kept those promises. I will continue to keep those promises to the People of New Hampshire. We will soon be back marching against the Northern Pass high voltage line proposal. The investigation of Tillotson Trust corruption and maladministration will continue, as will our efforts to seek justice and to expose the New Hampshire Attorney General’s corrupt activity.

“The fact that I prevailed in a New Hampshire court in a face-to-face confrontation with the Attorney General’s office attests to the strength of my legal arguments, my preparation and my courtroom presentation. I do not exaggerate or inflate my litigation experience. Not many lawyers could manage and conduct litigation in courts from one end of the nation to the other.

“In a few days we will be in Hawai’i fighting to open the public records of that state. Stay tuned.

“Candidates like to tout their experience. I am probably the most successful public interest lawyer in

(CONCORD, NH) (January 9-10, 2012) Independent Republican Presidential Candidate Andy Martin is en route to Dixville Notch, NH for the nation’s first voting at The Balsams Hotel later this evening.

“This is a sweet night for us, a celebration really, because it was my legal work that kept The Balsams in local hands. I am still working to protect The Balsams' employees from the Tillotson Trust. I promised the people of the North Country I would not abandon them, and I will not,” Andy says. “It is a gratifying story of what a presidential candidate can do if they know what to do. I am running for president in New Hampshire on a record of solid performance, not vacuous promises. I am the only candidate that has accomplished something for the people of New Hampshire during the primary election period. I have earned my spot as New Hampshire’s Favorite Son presidential candidate.”

The Merrimack County Superior Court has scheduled a hearing for January 18th on Andy’s ongoing petition to pry loose additional documents from the Tillotson Trust and the New Hampshire Attorney General.

(MANCHESTER, NEW HAMPSHIRE) (November 23, 2011) The man who has helped send crooked Chicago politicians to federal prison holds a news conference in Manchester, New Hampshire Wednesday to announce what he feels may be a major political scandal involving NH Governor John Lynch and NH Attorney General Michael Delaney. The controversy involves Andy Martin’s efforts to save one of America’s few remaining historic resort hotels, “The Balsams” of Dixville Notch, NH.

Independent Republican Presidential Candidate Andy Martin will hold a Manchester news conference today, Wednesday, November 23rd to level conflict of interest and corruption charges at Lynch, Delaney and the trustees of the Tillotson Trust. Andy says they have manipulated the Tillotson Corporation so as to endanger the survival of the North Country’s legendary hotel.

“All day Wednesday we will be taking investigative action to expose what I believe is a major political scandal in New Hampshire,” Andy says. “This one may arise in Concord, but the machinations involving the Attorney General, Governor and The Balsams have a distinctly ‘Chicago’ stench to the events leading to the purported sale and closing of The Balsams.”

On August 18th the New Hampshire Supreme Court denied an emergency writ Andy had filed to block the sale of The Balsams to Ocean Properties, but gave him permission to refile his charges in the Superior Court. Andy has been continuing his undercover investigation.

“The more I investigate the role of the governor and attorney general the more The Balsams situation in turning into a ‘Chinatown’ situation,” Andy charges “with endemic corruption throughout the New Hampshire power structure, much like the movie ‘Chinatown’ chronicled corruption in Los Angeles. There are conflicts of interest galore, as well as cross-currents that may link The Balsams to a related controversy involving the Northern Pass. I am particularly interested to see what Ovide Lamontagne’s role has been in all of this.

“Very honestly we stumbled across this scandal while campaigning across the state. If I had not been a presidential candidate it is unlikely we would have ever uncovered The Balsams corruption. But we did discover The Balsams scandal and we are ready to go public with accusations that will embarrass the administration as well as the other bottom feeders who are milking the Tillotson Trust,” Andy says. “The Balsams is a national historic treasure, and a great asset to New Hampshire. It is criminal the way the politicians and political bloodsuckers are destroying the property and eliminating hundreds of good jobs in the North Country. Wednesday afternoon we take our corruption battle to a new level. We name names and we will be issuing a de facto ‘presentment’ with specific allegations of wrongdoing.

“Quite by accident and not by design my presidential campaign has become a de facto anti-corruption strike force for New Hampshire. But then again my 45 years of corruption-fighting experience are why I am qualified to be the presidential nominee and my primary opponents are not.

“Life abounds in coincidences and serendipity. My ‘Battle of “The Balsams”’ is an example of just such an unanticipated event that flows from my fortuitous reappearance in New Hampshire as a presidential candidate.

“People who expect me to disappear from the New Hampshire scene on January 11th may be surprised,” Andy says.

Republican Presidential Candidate Andy Martin seeks forensic audit of New Hampshire's Tillotson trust assets

Corruption-fighting independent Republican Presidential Candidate Andy Martin has asked officials of the Tillotson Corporation and related Tillotson trust entities to open their books and records for an independent forensic audit. Martin is also asking to make arrangements to inspect and copy Tillotson files. Martin accuses Tillotson officials of “running down” The Balsams hotel and engaging in self-sealing without any meaningful public accountability. The Tillotson Corporation is part of a charitable trust for New Hampshire residents. Martin’s letter follows below.

Re: Mismanagement and corruption of Tillotson Corporation/Tillotson Trust/The Balsams

Request for access to books and records to conduct forensic audit

Dear Mr. Corbett:

If information that has reached me from Ocean Properties, Ltd. is accurate, it would appear that trustees of the Tillotson Trust and Tillotson Corporation officers who approved the “sale” of The Balsams could be criminally prosecuted.

I have been stunned at the way your board and various and sundry other related Tillotson entities allowed The Balsams to deteriorate, failed to invest in maintaining the quality of a North Country jewel, and then sought to dump the business on Ocean Properties as a distressed property.

The monkey business and self-dealing by your board has to stop.

Tillotson assets were left in trust for the North Country; they are a public trust, not a private piggybank for persons to enrich themselves outside the glare of public scrutiny.

Therefore, I would like to request the following:

First, there have been newspaper reports the Balsams will close early in September for its seasonal shut-down instead of staying open until its normal seasonal rotation in October. I ask that the hotel be kept open and operated normally.

What you are doing with your firing employees and opening / closing / closing/ opening the hotel is destroying the “going concern” value of The Balsams as a resort hotel. A hotel can't operate when it is announcing firings and openings and closings on a capricious timetable. Predictability is a hallmark of the hospitality business and The Balsams has an outstanding franchise value to maintain. You are undermining the “going concern” value of The Balsams.

Second, I ask that you issue a public commitment to reopen The Balsams on its normal schedule for the holidays. If it is your intent to kill the hotel through mismanagement and incompetence, so you can possibly try to pull another inside job and “sell” the hotel in a suspicious transaction you are making a good effort. The mismanagement and self-dealing of the Tillotson Corporation must stop.

Third, I would like to make arrangements to review the books and records of Tillotson Corporation and associated public trust entities which are funded though Neil Tillotson assets. It seems to me you have been operating as a de facto private corporation behind closed doors, and seeking to use secrecy and silence as a veil against public scrutiny of your activities.

Fourth, I would like to ask the board of Tillotson Corporation and related charitable boards for permission to conduct at my campaign’s expense a forensic audit of all Tillotson-related entities. It appears to me that there has been gross mismanagement and potential self-dealing by the boards of these entities.

Finally, I would like to be notified of Tillotson Corporation board meetings, and have these meetings publicly noticed and scheduled sufficiently in advance so members of the public and the media may appear and be heard. As a charitable entity, the board should not be meeting in secret or without adequate advance notice to the public. If the Attorney General will not do his job of protecting New Hampshire charities, I will.

The North County needs help. Tillotson resources are there to help and they are being misused and misdirected.

I am not threatening a lawsuit at this time because I hope my activity will embarrass Governor Lynch and General Delaney into doing their jobs as public officials. If they fail to respond and keep stonewalling, obviously there would be litigation to protect the Tillotson assets from private predators.

The time is now to “come clean,” open the doors, and start operating like a public trust and not a secret society. I encourage you to do so. As I indicated at the beginning of this letter, if the information from Ocean Properties is true, there are some very disturbing aspects of your behavior and the board’s behavior.

I plan to stay involved after the 2012 primary, so running out the clock is not an option for you. In addition, I will challenge in court any future actions by the board which I see as self-dealing, corrupt and violative of Neil Tillotson’s original intent to benefit the people of the North Country. Firing hundreds of people in the midst of a horrible recession is not helping the North Country. If he were alive Mr. Tillotson would be outraged by your behavior and the board’s conduct.

Last week I was contacted by a law firm that claimed to be the Tillotson Corporation’s attorneys. When I asked them to place their authority in writing, they never responded. This kind of chicanery and legerdemain has to stop. You need to operate as a public charity, not a closed corporation.

I will await your response before consulting counsel on how to proceed to protect the people of the North Country and to enforce the precepts of Neil Tillotson’s charitable bequest.
