Washington, DC news conference Sunday: Is Ted Cruz eligible to be president?

GOP presidential candidate and constitutional scholar Andy Martin will hold a Washington, DC news conference today, January 31st, to wrap up the Ted Cruz Birther Summit/National Conversation at the Capital Hilton. Andy has been an adjunct professor of law and has litigated constitutional cases. (New York) (January 31, 2016)  Republican presidential candidate and constitutional scholar/litigator Andy Martin will hold a news conference at the Capital Hilton today, Sunday, January 31st, to end the Ted Cruz Birther Summit/National Conversation with a Closing Report and analysis of Senator Ted Cruz’ eligibility to be elected president.

Andy is the constitutional scholar and litigator who over a decade ago raised the first concerns about President Barack Obama’s eligibility under the Natural Born Citizen Clause of the U. S. Constitution.

Andy returns to New York Sunday afternoon and then home to New Hampshire as soon as possible.

The three-day Summit/Conversation explored in depth (a) questions about the original intent of the Founders who drafted the Constitution; (b) subsequent constitutional amendments and their effect, if any, on the Natural Born Citizen (“NBC”) Clause, and (c) modern trends in constitutional interpretation and their impact on the NBC Clause.

“The term ‘Birther’ was originally intended by the media to be a pejorative description of anyone who challenged Barack Obama’s family history. The liberal media were insulating Obama from the many questions raised by his mysterious past,” Andy says. “But long ago I accepted the word ‘Birther’ as shorthand for a generalized expression of concern for constitutional eligibility under the Natural Born Citizen Clause.

“Although Senator Cruz was invited to cooperate and send someone on his behalf to our Washington sessions if he wished to do so, he did not respond or cooperate in any way with our request for documents.

“Ironically, many in the liberal media support Cruz’s point of view that he is eligible under the NBC Clause. The liberal media take a ‘liberal’ view of constitutional interpretation. Conservatives within Cruz’ own base, on the other hand, manifest the most concern about whether Cruz satisfies the constitutional mandate of being a Natural Born Citizen. One Poll has claimed that more than a third (36%) of Republicans have some doubts as to Cruz’ eligibility (please see link [1] below).

“While I previously raised and addressed almost all of the NBC Clause issues in the context of Barack Obama’s candidacy, see group link [2] below, and expressed my expert opinions at that time, this weekend we took a fresh look at the NBC Clause question. Other law professors have also expressed their views, see group link [3] below.

“In order to permit opportunities for the broadest possible participation and discussion we conducted an evening session on Friday the 29th, an afternoon session on Saturday the 30th and a morning session on Sunday the 31st.

“People who have read my work on Obama over the past twelve years know that when I don my candidate’s ‘hat’ I express my own partisan views. But when, as in the Summit/National Conservation, I undertake to conduct a scholarly discussion, I try to be scrupulously fair and impartial. I will, however, have more critical comments about Senator Cruz next week, but not in the context of today’s Summit/Conversation.

Iowa caucus attendees are paying close attention to our proceedings. Within hours after we disperse they will start participating in the presidential caucuses. In the close Iowa race our discussions and reporting from Washington could make the decisive difference.”

While in Washington Andy also researched, and later will be addressing other national and international issues; he has also started interviewing potential interns who may want to join his campaign.

CLOSING REPORT OF THE TED CRUZ BIRTHER SUMMIT/NATIONAL CONVERSATION

I. The origins of the Natural Born Citizen Clause

A. What the Founders feared in adopting the NBC Clause

We forget today how completely fragile the “United States” were at the time that the Constitution was drafted. There was a great fear that a foreign prince could come to America, produce an heir, and attempt to establish a royal dynasty. Today these concerns seem silly. In 1789 they were very real. The Constitution was drafted to restrict power, restrain power and control power. Most of that restrictiveness was directed at domestic despots who might be tempted to evolve. But there were clearly designs intended to limit foreign influence in the future. The Natural Born Citizen Clause was and remains foremost among the constitutional language intended to restrict access to the presidency.

B. The restrictiveness of the NBC Clause

The NBC Clause is intended to be very restrictive. The Founders wanted to limit, not expand, the range of persons who were eligible to be elected president. So it is simply meaningless to say the clause “disqualifies” or “discriminates” or is “unfair.” The clause was intended to be precisely that. Senators and Representatives need only be “citizens;” only the President must be a ‘Natural Born Citizen.” The common law was highly evolved around the time the Constitution was adopted. The term “natural born” had a recognized common law meaning. The Founders knew exactly what they were doing when they adopted the restrictive language for presidential eligibility.

C. Canons (“principles”) of constitutional construction

The Common Law developed in part through “canons” of construction, not unlike canons in ecclesiastical law. A “canon” is a generalized principle of law that directs how a legal question should initially be approached. One canon applicable to the NBC Clause is that all words have meaning, and that words are inserted with a meaning. Senators and Representatives need only be “citizens.” The NBC Clause applies solely to the office of president. The canon of statutory constriction that words mean something, and that special words mean something special, mandate that the phrase NBC means something, something specific and something special. So we can’t just ignore the NBC Clause.

II. Subsequent Constitutional Amendments and statutory enactments

A. Congress cannot amend the NBC Clause

There have been claims that after enactment of the Constitution Congress adopted laws that broadened the scope of the NBC Clause. Congress lacks any jurisdiction to amend or modify that clause. Congress has broad powers under the “naturalization” provision of the Constitution to create rights to citizenship, but those powers are entirely separate from the inviolate NBC Clause.

B. Did the Civil Rights Amendments modify the NBC Clause?

After the Civil War the nation passed the Civil Rights Amendments abolishing slavery and imposing rights applicable to the states under the Fourteenth Amendment. Some people argue that the “subject to the jurisdiction” language of the Fourteenth Amendment was intended to modify the restrictions of the NBC Clause. I do not believe the Supreme Court would recognize that argument. There is no question that the Fourteenth Amendment broadened access to citizenship, but that amendment was focused on remedying the horrors of slavery, not modifying the NBC Clause.

C. Have Supreme Court decisions “amended” the NBC Clause?

The Supreme Court lacks any authority to modify or dilute the NBC Clause. Only an actual and specific amendment to the Constitution can effect such a change. In fact, even liberals acknowledge the immutability of the NBC Clause. There have been several proposals in recent decades to adopt a specific constitutional amendment modifying or eliminating the NBC Clause. None have been approved by Congress, the first step in implementing a constitutional amendment.

III. Modern constitutional analysis of the natural Born Citizen Clause

A. “Originalist” interpretation vs. modern interpretation of old laws and constitutional provisions

Beginning perhaps with the Nixon presidency conservatives have vocally argued for implementing only the “original intent” of the Founders when they originally approved the Constitution. Liberals tend to follow the view that the Constitution is a “living” document and that interpretations can change. I agree with both approaches. The starting place must always be the original language and intent; but if that language and intent lead to an illogical or inconsistent result, modern generations can approve a Constitution that meets their needs. The “originalists” have been vocal advocates for their point of view; but over almost the past half a century the “living constitution” advocates have continued to prevail in actual Supreme Court decisions.

IV. The “Case or Controversy” principle of the Supreme Court

The Constitution only gives the Supreme Court jurisdiction in “cases or controversies.” The doctrine of “standing” is nowhere mentioned in the Constitution. But to effectuate the case or controversy limitation on it powers the Supreme Court developed the doctrine of “standing,” i.e. a requirement that a litigant must have an actual interest, and not merely a hypothetical or generalized interest, in a lawsuit which the court is asked to resolve.

There are already lawsuits involving Cruz’ eligibility. But because they are generalized attacks on Cruz these cases are unlikely to succeed one way or the other. I can’t predict with ironclad certainty whom the court would allow to challenge Cruz’ eligibility, but at a minimum that person would have to present more than a mere “public” interest in Cruz’ eligibility. The most likely challengers are actual, legally qualified candidates who are either running against Cruz or lose to him.

The “standing” doctrine raises a significant barrier to any lawsuits involving Cruz’ eligibility.

V. Andy Martin’s matrix for NBC Clause analysis

Lawyers love procedures. They love rules. And they love “process.” Here is my proposed method for analyzing NBC Clause cases:

If a presidential candidate was actually born in the United States, there should be a rebuttable presumption that he or she is eligible to serve. The burden of proof should shift to protesters. If, on the other hand, a candidate such as Cruz is born outside the United States, there should be a presumption of ineligibility, and the burden of proof of satisfying eligibility should be on the candidate, not protesters.

The only exception to this analytical matrix should be for persons born to U. S. representatives overseas, such as military personnel and diplomatic officials. Clearly, military facilities and diplomatic stations and related areas (such as hospitals, etc.) are de facto American soil.

Because Cruz was born outside the United States, under my matrix he is presumptively ineligible to serve as president and the burden of proving his eligibility is on him.

VI. The Bottom Line on eligibility: Ted Cruz’ ‘Conundrum’

Ted Cruz’ constitutional eligibility to serve as president is a conundrum. If you follow the principles of “originalist” interpretation that have been conservative dogma since the Nixon era, and which Cruz has always advanced in his own constitutional advocacy, there is serious doubt that the Founders intended for Cruz to be eligible.

If, on the other hand, you follow modern principles of constitutional interpretation, there is a valid basis for Cruz to be deemed eligible. There are still clouds and doubts, however, since all of the facts concerning his family’s presence in Canada have not yet been disclosed and analyzed. Did Ted’s mother accept government benefits for which only Canadians are eligible? Such receipt by her might affect a view as to whether she ever surrendered her U. S. citizenship, either intentionally or inadvertently. We simply don’t know. Cruz won’t say. He brushes off any public concerns.

If Cruz was elected president, and during his candidacy for the office, there would always be claims that he is not eligible under the NBC Clause. Cruz cannot escape them. Even under modern interpretations of eligibility, Cruz’ birth in Canada to only one U. S. parent raises at least a preliminary question as to his eligibility.

Is there a court that will address Cruz’ eligibility? There is serious doubt under the “standing” doctrine that a court will do so, unless a losing candidate or opposing candidate of Cruz’ elects to challenge him in court. Cruz’ claim that the matter has been put to rest by earlier judicial decisions is simply not true.

The Ted Cruz constitutional conundrum continues and will continue until Cruz is either defeated or a court actually rules definitively in a case where he is an actual party.

Presidential candidate Andy explains the “Boomer Backlash” against Megyn Kelly and Fox News; Andy answers the question “Is Donald Trump against women?”

As he explained in his announcement of candidacy Friday, conservative Republican presidential candidate Andy Martin is unlikely to become president. But Andy also described himself Friday as the “second-most exciting Republican Party presidential candidate (after Donald Trump).” In the first of what will be his “Letters From the 2016 Presidential Campaign,” Andy partially explains who Donald Trump “is,” (more coming on Tuesday). A couple of days ago I announced my candidacy for President of the United States. No, I’m not likely to become president, and I may not even be your choice for the Oval office. But maybe I should be. I bring a sense of history to the campaign, a sense of proportion, experience and wisdom that few of the others can match. And I am a writer.

I’m not sure exactly when I became a “writer,” but certainly no later than the occasion when I won “honourable” mention in a national writing competition in England as a teenager. I’ve done many things in my life, some good, some bad, but nothing has prepared me to be president so much as my career as a writer.

In this first of what I hope will be several, or even many, letters from the campaign, I will explain why Megyn Kelly’s snappy confrontation with Donald Trump about whether Trump was “anti-woman” blew up in her face and embarrassed Fox News. The usual pundits declared Trump “over,” “finished,” and “washed up” as a candidate after Cleveland. But he emerged the winner from the confrontation. No one has given any real explanation, let alone an adequate explanation, why Trump prevailed. I hope this letter provides you with some insight.

First, a little background into why a “writer” brings a different frame of reference and a different style of interpretation to the presidential campaign, and would to the Oval office as well. My campaign headquarters this weekend has been in a hotel, the Capital Hilton, where I first stayed 48 years ago, and where you might say I entered the clandestine world. The Washington of 1967 was very different than the Washington of today. Then we respected wisdom and experience, even when they got it wrong. Today we revile wisdom and experience and some even deny that they exist or that they have any relevance in government and politics.

Saturday afternoon my good friend Bill came by and we walked over to a “beer hall” Bill wanted to visit. Unbeknownst to Bill, he unexpectedly took me to a building which has been a part of my life for all of my life, a former night club on Connecticut Avenue where my mom partied as a young woman during World War II. During my many trips to Washington I got to meet her WW II friends and absorbed her love of the capital. For a time I had an office nearby on Connecticut Avenue. Bill brought all of these memories back to me when we walked me into a space where my mom had enjoyed good times during the years of the Greatest Generation.

During the course of the campaign I will be writing about my beloved Uncle Bill Vasiliou, a small town businessman and Republican Party official; my spinster high school teacher Louise Facius, whose brother enjoyed a game of cards with my uncle, and Professor Herbert Bogart who honed my skills as a writer. And others as well, of course. Their formative impact on my judgment, and hopefully my wisdom, influences how I interpret the world in 2016. Now back to Kelly and Trump.

So what happened in Cleveland between Kelly and Trump? In simple terms, Kelly slammed the Boomer Generation, and the Boomers slammed her back.

First, let me define the Republican Party of 2016 as no one else has defined it for you. Republicans today are the “Boomer Party.” Most of them are in their 50’s and 60’s and 70’s, the “Boomer” years (yes I know those decades do not exactly fit the definition of the Boomer years). Most of us who are Republicans today grew up during the Boomer era, during a period that spans the dawn of women’s equality and empowerment.

For myself, I was both immensely privileged while being sadly handicapped. My parents parted so my mom worked, eventually as a college professor. My girl friends all loved my mom because she was the precursor of today’s “modern” woman. Mom had originally entered the family business in Washington (special operations and intelligence). She went on to teach almost all of her life. Although she came from a humble immigrant family she was the most sophisticated and worldly person I ever met, bar none.

Donald Trump and I grew up during the same era. He came from a more traditional background, with a wealthier, intact family, etc. But I don’t think Trump’s college years were very different from my own, which is why I said on Saturday that while “on the surface Donald and I are very different people… our inner workings are very similar.”

One difference is that while the women’s movement largely passed Trump by during his formative years, I emerged into adulthood as a women’s’ rights activist. In 1969 I was a party at the Federal Communications Commission to the AT&T discrimination case (go check the docket, no. 19809) which resulted in a landmark settlement for women’s’ employment opportunity.

When I see Kelly blasting Trump for intemperate language about, yes, Rosie O’Donnell and others, I hear locker room lingo and fraternity house nonsense and dormitory discussions about the opposite sex straight out of the 1960’s. It is difficult today, in our simultaneously hyper-sexualized and politically correct world, to realize how unknown men and women were to each other in the 1950’s and 60’s. (At the University of Illinois they locked women up at 10:30 P.M., to protect them, of course.)

When Trump defends himself by saying he “cherishes” women and will “care” for them, he is speaking straight out of the 60’s. That is how we spoke back then in prehistoric times. Trump’s trash TV bombast has nothing remotely to do with his feelings about women, since his feelings were formed in the 50’s and 60’s. Yes, the 50’s and 60’s were a different era, but Trump has also modernized himself. Today he legitimately brags about employing lots of women, and the important roles they play in his company.

Now you can understand why Kelly touched a cultural hot button when she tried to use Trump’s sloppy language to smear him as anti-female. Boomers know Trump’s trash talk has nothing to do with his true feelings about women, feelings that were formed in the ultra-traditional 50’s and 60’s. For whatever its worth, I believe Trump does cherish women and would care for them as president. And I believe Boomers believe that too, which is why they reacted vehemently when Kelly tried to demean Trump as a misogynist.

Ailes called Trump to “make nice” because he realized that Kelly had defamed the network’s “base.” The Fox News “base” is much broader than just the Republican Party and also encompasses most of the Boomer Generation. Boomers are still very influential, and very vocal. Arthur Miller wrote, “Attention must be paid.” Fox News ultimately learned that lesson. So did Kelly.

The bottom line: when reviewing political issues and shameless media manipulation, always look behind the curtain to reflect on the cultural impact and social history of events. As kids, Boomers absorbed what today we consider fraught language; but they absorbed it from their parents, whom they loved and who loved them. Almost all of us have evolved into the modern era, where language is more circumspect and deferential.

Republicans and Boomers immediately recognized that trying to brand Trump as a woman-hater was morally wrong. Kelly had grabbed a few of Trump’s words out of context and tried to use them as an attack weapon. Her tactic backfired. Kelly was a disrespectful Boomer daughter who sassed her Boomer parents. And she got verbally spanked as her punishment. The more things change. [See Megyn Kelly link below for her marital history]

Hopefully Trump learned a lesson in Cleveland; I know Roger Ailes and Megyn Kelly did. The Republican Party is the Boomer Party. Don’t diss the Boomers, or they will snap back and diss you, big time. That explains why Boomers came to Trump’s defense, and why he is leading in the polls today.

I would bring the same insight and experience to the Oval office that I try to bring to writing about politics, history and culture. For now, you’ll have to be content with me as a writer and not as your president. Iowa, here we come.

Conservative New Hampshire Republican Party presidential candidate Andy Martin will hold a news conference at the Capital Hilton in Washington, DC Saturday, August 15th to explain how a “tag team” of Donald Trump and Andy Martin are going to bring down the Bush Family political dynasty. “Mr. Trump’s campaign and mine are not communicating or exchanging information. But in a ‘perfect political storm,’ both Donald and I are targeting Jeb Bush,” Andy says. “Trump has the big megaphone and he is focused on Bush’s special interest cash. I am leaving the ‘cash’ issue to Trump. I am targeting Bush personally. (Washington, DC) (August 15, 2015)  Newly-minted Republican presidential candidate Andy Martin told a Washington, DC news conference Saturday, August 15th to explain that although his campaign and Donald Trump’s campaign are completely separate, the two candidates have become a de facto “perfect political storm” which is coalescing to defeat Jeb Bush in the 2016 presidential primaries.

“In 1999-2000 my WMUR-TV anti-Bush attack ad – accusing George W. Bush of wanting to start a war in Iraq – helped defeat Bush in the New Hampshire primary,” Andy says. “In 2014, after New Hampshire GOP ‘leaders’ ran a ‘dirty primary’ for the U. S. Senate, I led a conservative backlash that defeated Scott Brown, as a warning to New Hampshire GOP brokers that when they rig a primary they will pay a price in the general election.

“To be precise and clear, Mr. Trump and I are not operating together. We each have separate campaigns. He is responsible for what he says and does, and I am responsible for what I say and do. But in the public arena, particularly when you have two experienced TV performers such as myself and Trump operating in the same space, it is not surprising that our campaigns have aligned de facto with the common goal of defeating Jeb Bush. I am not supporting Trump and he is not supporting me. But Donald and I are both working overtime to defeat Jeb Bush and his special interest secret supporters. The 2016 New Hampshire primary will be the ‘graveyard’ for the Bush Family’s political ‘dynasty.’

“Trump has the raw media power to weaken Bush. I have the negative information and hardball media tactics to make Bush a toxic candidate for the Republican base.

“The Bush Family fumbled away the presidency in 1992, and gave us Bill Clinton. I agree with Jeb that his dad, ‘Poppy’ Bush, is a nice man. But George H. W. Bush was a failed president. His son George W. Bush’s failed presidency in 2001-2009 gave us Barack Obama and Middle East chaos. George W. was the worst president in modern history until Obama rescued him from the cellar. Two failed Bush Family presidencies are enough!

“Trump obviously has a much better chance of winning than I do. I am clearly in the second division. But because I am also targeting Bush, and Trump and I share a common opponent, our joint efforts are effectively going to whack Jeb Bush from two directions. Jeb’s campaign will not survive. The Bush Family ‘dynasty’ will be cut short.

“The reality is that ordinary Republicans do not want Jeb Bush as their candidate. Jeb is a front man for a handful of corrupt plutocrats that have raped our economy and undermined our national security. Jeb Collected millions before Lehman Brothers collapsed and cost millions of innocent workers their jobs. Two failed Bush Family presidencies are two too many. Trump and I share a common goal, namely to end the Bush Family’s manipulation and control of the Republican Party as a vehicle for insider plunder and profiteering.

“Besides me, there are seventeen other Republican presidential candidates in the race. I can support 16 of them. But I do not believe Jeb Bush and his family are good for America. They have a proven record of political corruption and failed leadership.”
