(Concord, NH) (November 13, 2015) Republican presidential candidate Andy Martin is drawing attention to a WMUR-TV video of a news conference challenging Bernie Sanders’ eligibility to run as a Democrat in the 2016 New Hampshire presidential primary.

“I note the text of the WMUR story says the New Hampshire Republican Party supports Bernie,” Andy says. “May I remind the incompetent state chairman, Jennifer Horn, that last year the party’s favored choice for governor, Walt Havenstein, had his eligibility challenged by the Democrats through the same process?

“The secretary of state, moreover, does not pass on the legality of candidate filings, as GOP ‘spokesman’ Michael Zona incorrectly suggested. Vetting is done by the Ballot Law Commission, not the secretary. The secretary only reviews whether the papers are facially in order, not whether they are substantively lawful and proper.

“Jennifer Horn has consistently supported Barack Obama and attacked me for telling the truth about Obama. Now she is supporting Bernie Sanders. And she keeps losing statewide elections. I did not intend for my BLC complaint to trigger more incompetence from Horn & Co. I only note that there is a lot of conservative ferment and opposition to her mismanagement and biased management of the state party. This is just one more example of where Horn forgets the D’s challenged Havenstein, and she tries to take a swipe at me.

“Ms. Horn has no business as a state party leader; indeed, she has no role in politics. Respectful and legitimate challenges are routinely engaged in by Democrats. Horn’s favorite president, Barack Obama, got his start by having his opponent for the state senate ruled off the ballot after Obama filed a challenge to her nominating papers.

“If Horn is not removed as state party leader Kelly Ayotte is toast and New Hampshire will vote Democratic for president. Will the state party act to remove Horn, or just go down to defeat one more time?”

Andy is shortly expected to start running broadcast advertising calling for Horn’s removal.

(Concord, NH) (November 12, 2015) Republican presidential candidate Andy Martin will hold a Concord, New Hampshire news conference today, Thursday, November 12th when he files a Complaint with the Ballot Law Commission seeking to have Senator Bernie Sanders removed from the 2016 Democratic Party presidential primary ballot. Andy, currently inactive as an adjunct professor of law, has decades of election law experience at the federal and state level.

COMPLAINT CHALLENGING THE LEGALITY OF BERNIE SANDERS RUNNING AS A DEMOCRAT IN NEW HAMPSHIRE -

REQUEST FOR REMOVAL OF SANDERS NAME FROM PRESIDENTIAL PRIMARY BALLOT

Dear Secretary Gardner:

I would like to file a Complaint with the Ballot Law Commission asking that the name of Bernie Sanders be removed from the 2016 Democratic Party presidential primary ballot. Mr. Sanders is clearly ineligible to appear in New Hampshire on a Democratic Party ballot.

By filing this Complaint I mean no disrespect to Senator Sanders. I find him entertaining and provocative and I occasionally even agree with him. But he is clearly ineligible as a matter of New Hampshire law to appear on a Democratic Party primary ballot as a “Democrat.”

Mr. Sanders claims that he can run as a Democrat in New Hampshire “because there is no party registration in Vermont.” That claim is a complete red herring.

The reason Sanders is ineligible to run as a Democrat in New Hampshire is because he was elected as an Independent, and by his own admission is currently serving as an Independent in Vermont. Certainly in so far as candidates are concerned in New Hampshire, party affiliation is not like a flag of convenience or change of underwear (to use Mr. Sanders’ own phraseology).

Parties mean something in New Hampshire.

Here is my evidence challenging Senator Sanders (see attached documentation):

1. I am attaching the 2012 “Statewide Candidate Information Publication” from Vermont. The state-issued document makes clear that “The position statement(s) in this publication are written by each candidate and reflect the opinion of the candidate.” The document also claims “All candidate information was prepared and submitted to us by the candidate.” Sanders claims “Bernie is now the longest serving Independent in U. S. congressional history.” The web link is:

2. On the U. S. Senate web site, Sanders as of November 11th identifies himself as an “Independent,” not a Democrat. His senate colleague from Vermont clearly identifies himself as a Democrat. The distinction between the two senators is irrefutable. In his Senate biography Sanders again claims to be “the longest serving independent member of Congress in American history.” The web links are:

Since Sanders currently identifies himself as an Independent in the Senate, there is no lawful way he can run as a Democrat in New Hampshire when he claims to be an Independent in Vermont and Washington, DC. A candidate can’t switch parties from state to state, or from public office in Washington, DC to political campaign in New Hampshire.

I ask that Sanders’ name be removed from the 2016 presidential primary Democratic Party ballot and that if he objects that a hearing be conducted by the Ballot Law Commission, at which time I shall appear to prosecute my Complaint.

Sanders is, of course, free to run for president in New Hampshire as an Independent even if he is disqualified as a Democrat.

I would appreciate all responses/communication/correspondence by fax or email as I am traveling on a nationwide basis in my own presidential campaign and regular mail takes time to catch up. I hope the Commission will also try to accommodate my schedule.

Republican Party presidential candidate Andy Martin officially filed as a presidential candidate on Tuesday. Today, one day later, Wednesday, he is holding a Manchester, New Hampshire news conference to ask Jeb Bush to withdraw as a presidential contender. Andy, who has a decades long record as an “opposition” researcher and master of negative advertising, has vexed Jeb and the Bush family for decades. Andy helped defeat Jeb in Jeb’s first run for Florida Governor in 1994. Andy’s controversial ad in the 2000 New Hampshire primary accusing George W. Bush of wanting to start a war with Iraq helped defeat GW Bush in New Hampshire. Now Andy is back with a plan to defeat Jeb Bush in New Hampshire in 2016. Andy plans to keep attacking Bush until Jeb formally and finally withdraws as a candidature. “As long as Dracula’s (I mean Jeb’s) heart is beating, we need to keep stomping on the tattered remnants of the Bush dynasty,” Andy says. “With Jeb and me it’s not political, it’s personal,” Andy says, reversing the words of Michael Corleone (Bush also uses a Corleone analogy in his ads). Dear Jeb:

I go back a long way with your family. I visited your grandfather’s U. S. Senate office in Washington, and still remember his Administrative Assistant’s name (it was unusual). I was in New Hampshire in 1988 when your dad began his unfortunate path to the White House.

You and I first met in 1989, in Orlando at a RPOF event. In 1993 I started exposing your insider deals in Africa, with the headline “Andy’s ‘pumped up’ about Jeb Bush’s water pump deals in Africa.” Remember? In 1994 I announced that I would oppose you in the gubernatorial primary although I later filed for another office.

In 1999-2000 I exposed your brother as someone with an unbalanced state of mind who wanted to start a war with Iraq. How accurate was my 1999 prediction? Pretty good, eh? You retaliated by abusing your public office to harass me. Big mistake. You made what had been a political dispute into a personal one. Your current New Hampshire ads like to call you “Veto Corleone.” Well, you can call me Michael Corleone, because between us it’s personal, not business. Capiche?

I know you love your dad, and I am sure he is a wonderful man and a great dad (for that matter, so is your brother). But George H W was out of touch with America in 1992, and he is still out of touch with America. He can’t understand why his sons are rejected by the Republican Party? Is that rejection so hard to understand?

In 1989-1990 your dad’s incompetent foreign policy led Saddam Hussein to believe he could grab Kuwait. Remember April Glaspie? Who authorized her to tell Saddam we didn’t care what he did with Kuwait? If Glaspie had said “absolutely not” there would have been no First Gulf War. So your father’s talking credit for winning a war that he blundered into in the first place insults the intelligence of foreign policy experts.

Then there was your dad’s fiasco with the supermarket scanner. The only cogent reason for gun control is that your father shot himself in the foot when he broke his promise “No new taxes.” As a result of your dad’s incompetence as a leader, and his inability to work with Ross Perot, we got the Clinton Dynasty.

Now we hear how close the Bushes are to the Clintons. They should be close to you. Bush blundering created the Clinton regime.

My 1999 ad on WMUR-TV exposed that your brother George wanted to start a war with Iraq. Would you like to see a copy? My ad was and remains the most prophetic ad in American political history. In retaliation, you then abused your own public office in Florida to harass me for running the ad against your brother.

Your record in Florida? The true story has never been told. Certainly you threw a little conservative catnip to the base, to burnish your record as a “conservative.” But behind the scenes, crooked GOP operatives were getting rich. Hell, you were planning to get rich after you left office. You later profiteered from the same firms you had regulated as a governor. “Quid pro quo?” When it should have been Quid pro no. I am struggling to cull the “worst of the worst” of your record so that the People of America can finally learn the truth. There is plenty to work with if you know where to look.

You claim to have created an economic miracle? On the contrary, Florida “profited” from the economic bubble your brother created in Washington. The crash in Florida after you left office was horrendous.

As you are aware I have a reputation for being a master of negative campaign ads. The ad against your brother was prophetic; there is no other word to describe it. I predicted the second Bush Family War before anyone else. While your brother was “looking into Putin’s eyes,” (please see link below) I had already looked into your brother’s eyes, and was able to predict the disaster he would create. Your recent efforts to defend your brother’s failed presidency are sad.

There is one overriding reason to withdraw now and avoid paying the filing fee in New Hampshire. Even in the unlikely event you won the GOP nomination, you could not be elected. Too many Republicans would either stay home or vote for a third party alternative. As bad as the Clinton’s are - and contrary to Bush family propaganda that the Bushes and Clintons have become close, the Clintons are very, very bad - people are so fed up with Bush Family corruption and incompetence that many Republicans will not support you. Not only can’t you be elected, you will drag down much of the Republican ticket along with you. The Bush name is toxic with Republicans.

It’s time for you to sit down with your dad, still a fine man if an incompetent leader, and to explain to him why the Bush Dynasty is over.

You can withdraw now and maintain some shred of dignity, or you can come to New Hampshire and be wiped out in the presidential primary. What would an intelligent person do? Give it a thought. Pull a Perot if you want, and blame me for your withdrawal. But pull out before your dad is really embarrassed by your performance.

Even if you were to win the nomination, which no one thinks is possible at this date, I would be there to keep campaigning against you until the last vote is counted next November. I will support any Republican nominee except you. It’s not business, it’s personal. I am confident we will keep you out of the White House even if your corrupt Wall Street cronies unexpectedly manage to buy you the nomination.

You claim to be a gutsy guy (someone probably “advised” you to say that). Well, I’ve been waiting a long time to tell the American people who you really are, the same way I exposed your brother in 1999-2000. Welcome to New Hampshire.

Bush, accusing Bush of wanting to start a war with Iraq, and raising doubts about Bush’s fitness for the job. Many credit my negative ad with costing Bush a win in the New Hampshire primary. Parenthetically, I saw Bush as a warmonger long before Bush himself acknowledged his obsession with Iraq.

“Beginning with original research exposing Barack Obama as a fraud in 2005, in 2007-2008 I published pioneering columns that ultimately cost Obama millions of votes and gave rise to an anti-Obama movement that has now continued for almost a decade.

“Although in 2002 and 2003 I opposed the Iraq invasion as a folly, long before Donald Trump who arrived as an opponent probably in 2004, in 2003 I lived in Baghdad and exposed the utter incompetence of the occupation and predicted the rise of the insurgency with uncanny precision. I am the only presidential candidate in either primary with genuine foreign policy experience and with a public record and track record of having been ‘right’ on the big issues.

“In 2014, as a senate candidate, I led the opposition to the corrupt New Hampshire state Republican Party leadership’s effort to impose a Massachusetts import on New Hampshire Republicans. Scott Brown had to be defeated as a warning to Jennifer Horn and her backers, and we beat him and her. In 2015-2016 I am continuing my efforts to remove Horn because of her corruption and incompetence as a state party leader.

“Second, I will fight to preserve and enhance the importance of the New Hampshire primary and work to encourage the National Committee to abandon the circus in Iowa that every four years does significant damage to the ultimate GOP nominee. The anti-gay extravaganza last weekend in Iowa was a disgrace to every Republican, and to every American. One can question ‘gay rights’ without careening into vile language. I do not condemn peoples’ expression of beliefs, however misinformed. I do question the judgment of putting on an anti-gay clown show for GOP presidential candidates. The Iowa ‘process,’ if you can call it that, is a disgrace to democracy and should now be abandoned by the Republican National Committee.

“Third, in 2012 I filed as a candidate in the presidential primary to highlight ‘New Hampshire issues.’ I began a statewide march again the proposed Northern Pass power line. When my presidential campaign started running ads on WMUR against Northern Pass in 2011, few were aware of the controversy. By the time of the presidential primary itself in 2012 all of the ‘national’ candidates had joined my local opposition. In 2015, construction on the Northern Pass has yet to begin. I continue my opposition.

“Fourth, I will strive to reorient the national party away from the ‘donor disaster’ represented by the failed campaign of Jeb Bush, a campaign by and for plutocrats, and work to focus on real solutions that will help struggling families. Our party’s so-called ‘job creators’ are not only a fraud on the American people but also, most of all, a fraud on ourselves. The ‘donors’ are ‘job destroyers,’ not job creators. We keep losing presidential elections because our promises for the future are divorced from the reality of everyday Americans.

“My family came to Manchester 100 years ago, took advantage of New Hampshire’s educational opportunities, created a small business, and set the foundation for a century of progress and prosperity in this state.

“Ultimately, I work for the people of New Hampshire, not Jennifer Horn and her corrupt party bosses.

“Unlike some ‘vanity’ candidates that simply file their names for the primary and then do nothing, I will actively campaign across the state and across the United States and attempt to appear wherever I am welcomed to speak.”

“Fifth, unlike some of the other candidates, I am a ‘commonsense conservative’ schooled in the practicality of Granite State-style solutions, not grandiose promises to make the rich richer and, ultimately, the poor poorer. The ‘donor class’ betrays not only our Party but also the American People. Wall Street’s hucksters in both parties (the Democrats are just as guilty as the GOP) are doing continuing damage to both our economic future and our national security.

“I am proud to be a New Hampshire conservative and I am proud to be a national Republican. I will strive to influence the process in 2016 just as I have done so in earlier decades,” Andy promises. “I hope the next 100 years for my family will be just as productive and successful as our past 100 years in Manchester.”
