Wednesday night liberal foghorn MSNBC was filling the airwaves with discussions of the media’s latest conspiracy conundrum: why is Donald Trump continuing to attack Megyn Kelly? Rachel Maddow even rolled out ancient CBS News war horse Daniel Rather to opine. Maddow and Rather speculated Fox and Trump might have created an elaborate conspiracy where they attack each other for mutual profit. I doubt the existence of such a conspiracy.

In my opinion, there is a motive behind Trump’s attacks. I can’t say that my views are entitled to any greater weight than those of others, but there is one significant difference: I am the only one who has known many of the players for thirty years.

In the 1980’s, Trump and I ended up on a list of prominent New Yorkers. Again in the 80’s I was battling Rupert Murdoch. Murdoch’s lackeys and I tangled again in 2008. Murdoch was groveling to Barack Obama and ordered his flunkies to throw me under a bus, which they did. I have no love for Fox News or Murdoch, who I believe is increasingly senile.

While I am by no means an insider, I have been on the inside/outside of many media battles over the decades. And because of all of these tussles I can look inside the players to see what really motivated them. So here are my thoughts.

1. Who is a journalist?

Is Megyn Kelly a “journalist?” She calls herself one. Is Jorge Ramos a “journalist?” He also claims to be one. Neither of them are journalists, that is unless you define the term “journalist” into meaningless.

Ramos is a criminals’ advocate who agitates for a state of lawlessness across the United States. He is a media thug who is paid to arouse his audience and to keep his viewers in frenzy against the “gringos” that Ramos excoriates as the oppressors of his “community.” Ramos has a Castroite view of America; all he lacks is complaints of “Yanqui imperialism” to make him a full-fledged Fidel Castro acolyte. How Ramos acts has more in keeping with wearing a brown shirt and lederhosen than it does with the practice of journalism as the neutral reportage of news. Tuesday Ramos went to a Trump event to crate a disturbance, not to act in the role of a bona fide journalist. Ramos succeeded in creating a fracas. But he also blew his cover. Going forward, no genuine journalist should refer to Ramos as a legitimate “journalist.”

And where was Ramos on Wednesday night? Why on Megyn Kelly’s show attacking Trump. Surprise! Ramos won’t go on the O’Reilly Factor, also on Fox News, but he popped up on Kelly’s nightly shebang. Hmmm. What does Kelly have that O’Reilly lacks? Winners and losers at Fox News? Playing favorites? A conspiracy? You be the judge.

Kelly is an attractive, intelligent person who tried the practice of law and decided she could make more money appearing on TV. She has succeeded. She also claims to be a “journalist” but she is not. Kelly is an entertainer and she is by no means a free agent in what she says and does. She is merely a major actor in a kabuki drama that is orchestrated by Fox News to entertain conservatives every day and to make piles of cash for Murdoch every year.

I watch Fox News, and it is entertaining. Roger Ailes, who created Fox News, would like you to believe it is a “conservative” political outlet. And Fox hosts do indeed espouse conservative views from time to time. Some, like Sean Hannity, may even be true believers. But the straightforward goal of Fox News is to make money, lots of it, nothing more and nothing less. Rupert Murdoch is a businessman who will - in true Trumpian confessional fashion - do and say whatever it takes to make more money. Despite his increasing senility Murdoch still controls the Fox Empire.

2. Is Megyn Kelly really a free agent?

What most viewers do not realize is that TV “hosts” do not create their own programs each day. There is a vast army of people who labor behind the scenes. To be sure, Kelly and others like her help sculpt the final product, and they present the program on the air, which is why they are called “presenters” in England. But the “product” is actually produced as a collaborative effort behind the scenes, not in front of cameras.

When Fox and Sean Hannity needed me to make news and promote a program in 2008, they worked with me. When orders came down from Rupert Murdoch to have me shot, they took out their pistols and started shooting. Hannity, Kelly and others are not free agents. In reality, they do what they are told; and what they tell their viewers is often manipulated from behind the scenes by producers and corporate handlers.

Bottom line: what Kelly does (and I am not picking on her) is entertain. Journalism is not a part of her job description. That is merely her fantasy. Kelly’s producers create a list of guests and “contributors” and she guides her program with gestures and intonations intended to entertain. Before the now-notorious Fox News presidential “debate,” Kelly and others made a grand scene of telling us how they were “preparing.” It was all part of a dramatic ruse. Always lurking behind the public facade were the corporate bosses. And the corporate bosses were under orders to destroy Donald Trump. Because Rupert Murdoch wants to destroy Donald Trump.

The “debate” questions that were directed at Trump were not “tough” questions as they were falsely portrayed. They were smears intended to demean Trump in front of the other candidates. The tactic backfired with the actual viewing audience. People could see that Kelly and Chris Wallace were asking unfair questions of Trump and asking relative softballs of the other candidates on the stage. The others were asked about “issues;” Trump was asked questions about personal matters that were taken out of context and intended to demean him and distort his image. After the debate I wrote about the dirty tactics of Fox, and I only repeat now because Trump still does not trust Fox News to be fair.

3. Who is Trump’s real Target?

After the debate debacle boomeranged on Fox News Roger Ailes tried to make nice by calling Trump. A truce was declared, or so it seemed.

Why did a new round of accusations erupt earlier this week prompting Trump tweet new attacks against Kelly, and prompting  new round of accusations against Trump from Fox News management? Here are the facts: Rupert Murdoch is apparently sailing off the coast of Australia on a luxury yacht, bored, restless and itching for a rematch with Trump. I am not suggesting Murdoch is gaga, but he is on the road to gagadom. All along, Murdoch planned to play king maker, and to select one of the GOP “16” as his champion for the White House campaign of 2016.

Trump exploded Murdoch’s strategy by coming on strong and pushing the other “candidates” out of the media’s eye. Like many super-wealthy people in declining years and with declining powers, Murdoch is frustrated, probably angry and trying to reverse the pending collapse of his grand political plan. Trump is proving to be a much more durable and acceptable candidate than Murdoch ever imagined he could be.

And despite being a little gaga, Murdoch loves to tweet. Murdoch has not hesitated us his Titter account to attack Trump. Over the weekend, Murdoch damned Trump with faint praise, claiming Trump was now a “serious candidate.” What Murdoch really meant was that Trump is a serious threat to Murdoch’s grand strategy. Murdoch went on to raise the ante by promoting a new idea, that former New York Mayor Michael Bloomberg should run as a presidential candidate, though of which party it is not clear.

Murdoch’s tweet of a Bloomberg candidacy was merely a tweak intended to irritate Trump, and Trump did not take long to respond. Within a day of Murdoch’s move, Trump fired back by renewing his attacks on Kelly. Here is why my analysis comes into play.

Trump is no fool, and he also has an impish streak (which many do not understand and falsely attribute to malevolence). Trump knows that Kelly is the “crown jewel” of the Fox News prime time lineup. Why would Trump attack Murdoch, when many people have no idea who Murdoch is and Murdoch himself may not have any idea where he is (for the record, off the coast of Australia)?

Rather impishly, Trump chose to attack Kelly, whom everyone knows and with whom he had already had a fracas. Roger Ailes could and probably should have ignored Trump’s latest machinations but Ailes either could not restrain himself or orders came from the yacht sailing off the coast of Australia to retaliate against Trump with a searing response whose intensity bore no relationship to Trump’s mischief.

And so it goes. Apologies are demanded, and denied. Charges are made and put aside. Kissing-and-making-up is a constant process. The “great game” for supremacy in the 2016 presidential race between the egos of Donald Trump and Rupert Murdoch continues unabated.

At least my theory makes sense. With all due respect to Dan Rather and Rachel Maddow, theirs does not. Tit-for-tat is one of the oldest of tactics.

We have not heard the last from Murdoch, a King Lear-like figure sailing off the coast of Australia and lamenting Trump’s usurpation of the 2016 presidential campaign. And we have not heard the last from either faux journalists and criminals’ advocates such as Ramos, or smooth and suave entertainers such as Kelly. Luckily, I’m the outsider who can give you the inside analysis even while I campaign as a presidential candidate to advance my own agenda of issues.

Presidential candidate and author Andy Martin explains why Donald Trump is showing increasing signs that Trump may be developing into a president-in-the-making

Republican presidential candidate Andy Martin says that Tuesday night in Dubuque, Iowa Donald Trump may have crossed the Rubicon from candidate/politician to president. Andy says that Trump’s news conferences and speeches, while still flawed, are improving markedly. Trump’s manner of handling the hooliganism of Jorge Ramos showed Trump is growing into the presidential role, much as Ronald Reagan did after February 23, 1980 when he asserted his rights as a candidate. Andy is also proud to announce he is hoping to combine his “letters” on the campaign into a book, and has started looking for a publisher.

As I started writing this letter after Donald Trump’s Dubuque speech, preparing to present my take on Trump’s “Ronald Reagan moment,” I kept monitoring the cable channels. Don Lemon and Douglas Brinkley on CNN had the same reaction I did. CNN played the clip from February 23, 1980 when candidate Ronald Reagan grabbed a microphone and asserted his control over a campaign event (please see link [1] below). Reagan was on his way to the White House.

Jorge Ramos, a pompous anchor of Univision, went to a Trump news conference, being held before a Trump speech in Dubuque, to create a disturbance (please see links [2][3] below).

First of all, it is important to note that Univision clearly and indisputably breached a contract with Trump. Second, because a lawsuit is pending between Trump and Univision, the parties are strictly speaking not supposed to meet without lawyers present. So Trump can legitimately refuse to interact with Univision employees while the lawsuit is pending.

Ramos was there to create a media moment, and he did. When Trump called on another reporter Ramos stood up and started delivering a diatribe. Trump had Ramos ejected for being rude and obstreperous.

In 1980, Reagan crossed the line from candidate to president when he asserted his control of the microphone at a campaign event. August 25th, Trump crossed the same line from candidate to president.

If you watch Trump’s speeches it is impossible to ignore his constant improvement both in delivering a speech and in conducting a news conference. Tuesday night he looked presidential in answering questions. When Ramos tried to disrupt the news conference, Trump calmly had him removed. After his trip to the penalty box Ramos was allowed to return. He got to ask a series of questions while still continuing to pontificate.

Let me start by explaining a developing bias on my part. I have watched the Black Lives Matter group disrupt political meetings and I don’t like it one bit, even though I deeply believe in the underlying theme that Black Lives Matter.

Likewise, I am growing weary of endless threats from Hispanics/Latinos to disrupt the 2016 presidential election by voting for candidates who support Latino demands that the United States surrender its sovereignty and allow uncontrolled illegal immigration.

Increasingly I see the matter the way many attendees at Trump events must see the Latino disruptions. What gives you the right to demand a right to break our laws? If you are a legally registered voter, i.e. a citizen, then your loyalty is to American law, not Mexico, Central America or anywhere else in the world. The idea that U. S. citizens are agitating for people from another country to be allowed to violate our laws is deeply disturbing to me as I believe it is to every loyal American. Yes, loyal American. My loyalty is to the red, white and blue, not the nations from whence my family came in earlier generations. I am very proud of my heritage, but I claim no right for people from my heritage countries to come here and break the law.

The media deride the feelings of Trump supporters. I think Trump is being truthful and authentic when he says he loves Hispanics. But as a potential president he realizes respect for the law is a cornerstone of American citizenship and American strength. And of a winning campaign. When Jorge Ramos stood up and started acting like an ass, instead of a journalist, and started delivering a speech and demanding to be heard, I was not impressed. I am very much not impressed by people who find Ramos’s behavior acceptable.

It is about time to remind Latinos/Hispanics that when they were either born here or took the oath of allegiance to the United States, they surrendered all loyalty to their former countries, and they should start acting as Americans instead of as foreign agents.

Trump played beautifully against Ramos’ boorishness. In fact, if Trump could have paid Ramos to deliver Ramos’ act, he should have done so.

I well remember the same liberal media types that used to call Reagan a “movie actor” and are now deriding Trump. The American people do not like media arrogance and yes, they don’t even like media arrogance and corruption when it is delivered by Fox News (see below for my upcoming analysis of the Trump/Kelly drama).

Trump still has to up his game as a speaker. He may think he is a great speaker but he has a lot to learn. He can speak without notes; that’s great. But he needs to deliver his ideas more concisely and more crisply. His speeches have improved markedly and if he keeps improving he will be very formidable as we move into September.

But Mr. Trump is learning to be a president. He proved that to me in Dubuque, Iowa, a town I know well. President Reagan, meet president-in-the making Donald Trump.

When I announced my own campaign for the Republican presidential nomination I made it clear I did not expect to win. Rather, I am advancing a series of agendas in which I passionately believe, such as preserving the New Hampshire primary, protecting the memory of Alexander Hamilton and other issues. If someone wants to invite me to a debate or meeting or speech, I am happy to appear as a candidate. If not, well, I am not going to “Pull a Ramos” and try to disrupt an event. I have serious issues which motivate me, not the least of which is a strong desire to see that the Mexican-American candidate for president, Jeb Bush, is not nominated. And, like Donald Trump, I am enjoying myself. Immensely.

I have spent my entire life “in the arena,” on the playing field. But I am primarily not a player, I am a writer and analyst, if a clandestine one at that. Over the past few days, as I have watched the Trump campaign unfold I have thought, “there is a great book in all of this.” Whether Trump wins or loses he has changed the course of America, forever. So I am hoping to take the letters I am writing, of which this is one, and combining them into a book, “Blue Collar Billionaire: Donald Trump’s quest for the presidency.”

My book on Barack Obama (see below) became the original bible on “Barry O.” I knew Obama from the streets of Chicago, I knew him as no one else did. And I have known Trump or watched him for 36 or 37 years, when I approved his first lease as he moved from Queens into Manhattan into a condominium where I served on the board of directors.

I have started looking for a publisher and an expanded budget. I will remain a candidate into next year, until the Republican nominee is chosen, whom I will almost certainly support (unless it is Bush). And I will also be active as a writer on the campaign trail. Please wish me well.

New York news conference: Presidential candidate Andy Martin asks Pennsylvania Supreme Court to suspend judge for anti-Greek remarks

Republican presidential candidate Andy Martin will hold a news conference today near LaGuardia Airport to announce he is asking the Pennsylvania Supreme Court to suspend a Delaware County Common Pleas judge who made anti-Greek remarks in a judicial proceeding. “There is no place for bigotry of any kind in a judicial proceeding,” Andy says. “The actions of the Delaware County judge in Pennsylvania in gratuitously attacking Greek-Americans as a class, without any provocation, and making bigoted remarks, is unacceptable. Almost 100 years ago, Greek-Americans formed a civic organization, AHEPA, to fight anti-Greek defamation. Obviously, that task continues. I am asking the Pennsylvania Supreme Court to immediately suspend Judge Michael F. X. Coll until the formal judicial disciplinary process can work.” Andy has previously been given special leave of court to appear before the Pennsylvania Supreme Court. A copy of his petition to the Pennsylvania Supreme Court is an attachment to emailed versions of this release. The petition should be received and filed Tuesday.

Constitutional scholar and presidential candidate Andy explains why Donald Trump is correct when Trump says that a constitutional amendment is not necessary to eliminate automatic citizenship for children of illegal immigrants or “anchor babies.”

Donald Trump has triggered a great national debate on illegal and legal immigration. In the following comments I endorse Trump’s claim that a constitutional amendment is not required to eliminate automatic citizenship for the children of illegal aliens, or so-called “anchor babies.”

1. Trump has triggered a worthy constitutional debate

As I said last week in Washington, I wear two hats in this presidential race. I am a dark horse candidate, but doing no worse than the half dozen or so similarly situated candidates who are near “0” but are still treated by the national media as though they have a chance of winning.

And I come to the campaign table with a long and extensive resume of experience in the real world, from foreign policy to fighting political corruption to advocating for an end to illegal immigration. Like Donald Trump I contemplated the prospect of building a family real estate fortune. But unlike Donald I took what Robert Frost called “the [road] less traveled by, and that has made all the difference.” And as is so often the case when I look at Trump-the-candidate, I see someone who might have enjoyed living the unconventional life I did.

One of my areas of interest has been constitutional litigation and scholarship. I have studied the illegal immigration crisis for a long time, ever since Senator Edward “Ted” Kennedy in 1965 worked to pass an immigration law that would radically change the ethnicity of the United States.

Thus I was absolutely delighted when Donald Trump decided to issue his first policy paper on immigration and the illegal immigration crisis. Trump has triggered a “great national debate” on constitutional law concerning citizenship and immigration.

Wednesday night, MSNBC host Lawrence O’Donnell was citing the 1845 common law case of Lynch v. Clark (please see link [1] below) to justify the legality of anchor babies. What O’Donnell did not realize is that both Congress and the states are free to change the common law, and that the Fourteenth Amendment gives Congress extensive powers to legislate in the area of citizenship. (For example, the United States inherited “common law” marriage; all of the states have since repealed that status.)

But whether you support my views and Trump’s views, or endorse opposing views, I think it is wonderful that Americans are having this national debate. That’s what elections are for. We will be a stronger nation for having thrashed these issues out in the national arena.

2. Should the GOP be afraid of Hispanic threats to retaliate?

I spent many years with the Florida Republican Party. Hispanics are an integral part of the party's base. Republicans are not even remotely anti-Hispanic or anti-Latino merely because we support secure borders and strict citizenship requirements.

The media and the Democratic Party’s illegal immigration supporters are constantly warning Republicans that Latinos will take revenge at the ballot box because Republicans seek to define and defend our national and constitutional borders. Should Republicans be afraid?

If supporters of illegal immigration feel so antagonistic towards America and American values, they are not real Americans. Americans put America first, not their former homelands. People who support breaking our immigration laws are no better than people who support robbing banks. In both instance they are supporting criminal acts. Respect for the law and for our constitutional values is a cornerstone of American citizenship.

Republicans may be risking a Latino backlash, but Latinos are also risking a massive American backlash. Barack Obama has already delivered Republican majorities in the House and Senate to Republicans. I am confident the White House will be next.

American citizens and legal residents of Latino heritage or indeed any heritage should be strong supporters of our immigration laws and traditions. The place to change immigration laws is in Congress, not on the Rio Grande River. People who support illegal immigration and threaten retaliation on Election Day are admitting they do not have the support of the American People to lawfully change our laws.

3. My own writing on “anchor babies”

Here is what I wrote eight years ago in 2007 on anchor babies (see link [2] for my full statement):

“I have researched the applicable law in detail, and the legal issues are complex. But I am convinced that Congress has the power to override Plyler v. Doe, 457 U.S. 202 (1982), which was itself only a 5-4 decision. Thus, even on the Supreme Court an issue analogous to anchor babies was a closely divided matter.

“Illegals present in the United States are at best ‘visitors.’ They enjoy the protection of U. S. laws, but that does not necessarily mean they are automatically entitled to create citizenship for children that are born during their visits. I don’t think, for example, that Mexico grants automatic citizenship to children that are accidentally born there to visitors or tourists.

“The Fourteenth Amendment grants Congress broad powers under section 5. The Supreme Court has shown great deference to congressional enactments in the area of citizenship and naturalization, as indeed it must under Article I, section 8 of the Constitution. Clearly under the legal doctrine of ‘original intent’ the several states did not intend by adoption of the Fourteenth Amendment to grant citizenship to the children of persons who had entered the United States illegally.

“A federal statute would, in order to be constitutional, operate prospectively, i.e. in the future. Congress does not have the power to revoke citizenship that may have been granted under existing interpretations of the law.

“But by removing the anchor baby incentive for illegal immigration we would cut off future Arellano travesties, where someone gives birth to create an anchor for continued illegal presence in the United States.”

Obviously, I have studied the constitutional issues involving illegal immigration for a long time. And I have also presented carefully crafted solutions to end the anchor baby crisis. Unlike the many cable TV bobbleheads who pop off on the issue of anchor babies, I have given the situation a constitutionally nuanced review. I am convinced a constitutional amendment is not necessary and that Donald Trump’s views on that point are correct.

4. Trump overlooked the growing “birth tourism” scandal

Ironically, in seeking to explain the extent of the current immigration crisis Trump did not even mention “birth tourism.” Birth tourism occurs when someone comes to the United States with the specific intent to give birth and create American citizenship, see link [3] below. Are you outraged by birth tourism, or do you think it is a great idea that foreigners come here on a tourist visa to give birth? Let me know, and let Donald Trump know. Tell him “Andy sent me.”

5. Where do we go from here?

Trump has changed forever the trajectory of immigration reform in Congress. The flaccid Republican congressional leadership will have to adopt a more aggressive approach, or congressional leaders will be removed in 2017.

Jeb Bush’s political pedigree as a self-styled Mexican-American has been demolished. Bush is no longer a credible candidate for the Republican Party presidential nomination, whether Trump prevails or not. Bush is finished as a potential national leader of the Republican Party.

Because Trump has created what will evolve into a new Republican “base line” on immigration, whether he wins the nomination or not, he has changed the future of politics in this country. As immigration activists continue to agitate for the United States to surrender its sovereignty to an uncontrolled invasion of foreigners from Mexico, Central America and other parts of the world, an American “backlash” is emerging to fight the proponents of unlimited illegal immigration. Trump is making what was once thought to be “unthinkable” and “impossible,” thinkable and possible: secure borders and an end to illegal alien birthright citizenship.

Americans are striking back and taking back their nation from the tide of illegal immigration and those internal saboteurs who are striving to subsume the United States in a Third World morass.

(New York) (August 18, 2015)  Newly-minted Republican presidential candidate Andy Martin told a New York City news conference today, Tuesday, August 18th to offer the first installment in his ongoing analysis, “A Psychological Profile of Donald Trump as a Presidential Candidate.”

In February, 2007 Andy authored a psychological profile of then-Senator Barack Obama that accurately predicted Obama could not function under the stress of the Oval Office and would be a weak leader. The Obama profile is still on line and can be read.
