(CHICAGO) (April 19, 2012) Republican Presidential candidate, New Hampshire corruption-fighter and conservative blogger Andy Martin won a landmark court victory in the New Hampshire Superior Court when Justice Larry M. Smuckler ruled in Andy’s favor and forced the New Hampshire Attorney General Michael Delaney to release files concerning the sale of Tillotson Trust property which Delaney was fighting to keep secret.

Andy is based in Chicago and New York (see bio below) and now maintains a public service office in New Hampshire.

“During the course of the presidential primary campaign and in my final message to New Hampshire citizens (the video is available on my web site, see above) I promised New Hampshire residents I would not abandon my public service efforts on their behalf after the primary.

“I conducted a Superior Court hearing on January 18^th, and Justice Smuckler thereafter ruled in my favor concerning the release of documents involving the sale of The Balsams. (Justice Smuckler also ruled financial reports were subject to an exemption, and that statutory exemption concerns me.)

“I continue to believe the Tillotson Trust is being corrupted and mismanaged to benefit insiders and in violation of the intent of Mr. Tillotson who created the Trust. I am also convinced the New Hampshire Attorney General is failing to properly administer and supervise the Charitable Trust Unit and has engaged in fraudulent and corrupt official conduct.

“Nevertheless, I won a landmark victory when Justice Smuckler ruled that the secret files concerning the purported ‘sale’ of the landmark hotel, The Balsams, must be disclosed. I have received those documents and they are being reviewed by my office. The Attorney General had tried to bar me from examining The Balsams sale records.

“My political activity is based on a 46 year record of public service and public integrity. I made promises in New Hampshire and I kept those promises. I will continue to keep those promises to the People of New Hampshire. We will soon be back marching against the Northern Pass high voltage line proposal. The investigation of Tillotson Trust corruption and maladministration will continue, as will our efforts to seek justice and to expose the New Hampshire Attorney General’s corrupt activity.

“The fact that I prevailed in a New Hampshire court in a face-to-face confrontation with the Attorney General’s office attests to the strength of my legal arguments, my preparation and my courtroom presentation. I do not exaggerate or inflate my litigation experience. Not many lawyers could manage and conduct litigation in courts from one end of the nation to the other.

“In a few days we will be in Hawai’i fighting to open the public records of that state. Stay tuned.

“Candidates like to tout their experience. I am probably the most successful public interest lawyer in

“This is a sweet night for us, a celebration really, because it was my legal work that kept The Balsams in local hands. I am still working to protect The Balsams' employees from the Tillotson Trust. I promised the people of the North Country I would not abandon them, and I will not,” Andy says. “It is a gratifying story of what a presidential candidate can do if they know what to do. I am running for president in New Hampshire on a record of solid performance, not vacuous promises. I am the only candidate that has accomplished something for the people of New Hampshire during the primary election period. The Merrimack County Superior Court has scheduled a hearing for January 18th on Andy’s ongoing petition to pry loose additional documents from the Tillotson Trust and the New Hampshire Attorney General.

(CONCORD, NH) (January 9, 2012) Independent Republican Presidential Candidate Andy Martin will hold a Concord, NH news conference Monday morning, January 9th to announce that the Superior Court for Merrimack County has set a hearing on Andy’s lawsuit to “Save The Balsams” from being sold to be dismantled. Andy filed New Hampshire “Right to Know Law” requests that were essentially ignored by the Governor and Attorney General.

“The Balsams” is the landmark New Hampshire hotel where presidential primary voting historically takes place at midnight. Monday afternoon Andy will head to The Balsams at Dixville Notch to be present for the presidential primary voting. The Balsams will only be open for voting and is otherwise closed. A copy of Andy’s letter to the law firm for The Balsams follows below.

“Hundreds of employees are losing their jobs, while the Tillotson Trust’s lawyers enrich themselves,” Andy says. “Trust assets are being maladministered. This is a major New Hampshire scandal and we are developing a permanent presence in the state to protect the public from corrupt and lackadaisical politicians who refuse to defend the public from professional predators.”

Dear Attorney Dutton:

You previously entered an appearance in my New Hampshire Supreme Court case that was dismissed by the court without prejudice to being refiled in the Superior Court. Late in 2011 the case was refiled and the Sheriff has served both the Governor and the Attorney General.

The press of a primary election is not the easiest time to pursue civil litigation but we are doing our best. However, we are working to develop a permanent public interest presence in New Hampshire to ensure that the People of New Hampshire and the People of the North Country who are beneficiaries of the Tillotson Trust are not shortchanged by the trustees, law firms and other hangers on. I have serious concerns about the mismanagement of the Tillotson Trust.

I would very much appreciate it if you would please advise me as to the following issues:

1. Will you be representing the Tillotson Trust in the current lawsuit? Although the AG and Governor are the real parties in interest in a Right-to-Know case, I named your clients as nominal parties out of an abundance of caution due to the potential ancillary relief which is being sought. Do you want to accept service and/or notice on behalf of your clients?

2. We will be issuing a stream of communications to the media concerning your clients’ apparent mismanagement and corruption and recalcitrance to make financial information available about the Tillotson Trust. I previously wrote to your client and have received no response. I am not going away.

Do you wish to be placed on a list to receive those media notices, so you may be aware of them and be prepared to respond, or would you prefer not to be emailed with copies of our media information? We have provisionally placed you on our email list, but will promptly remove you at your request.

3. We normally notify opposing parties by email with the exception of documentary exhibits. Are you willing to accept emailed notices?

4. I do not know yet if New Hampshire judges conduct telephone hearings in court cases. If they do, and a phone hearing is available for the scheduled hearing on January 18th, do you object to my being heard by phone?

5. If you have any questions, please feel free to call me. This Monday and Tuesday (January 9-10) I will be on my cell phone; normally I can be reached through my national headquarters.

While public interest litigation can become adversarial, I always endeavor to treat opposing counsel with professional courtesy and fairness as long as that approach is reciprocated. There is always the possibility we could meet Tuesday to discuss potentially narrowing the issues or trying to reach a reasonable settlement for all parties concerned. Please advise if your clients are interested in pursuing this approach.

Finally, out of an abundance of caution and professional courtesy, I would like to advise you that I will be at your client’s hotel premises for the 2012 presidential primary voting at Dixville Notch Monday evening/Tuesday morning (January 9-10).

BULLETIN: Late Wednesday afternoon Andy Martin filed suit in NH Superior Court to expose corruption by NH Governor John Lynch and AG Michael Delaney concerning fraud and corruption involving tens of millions of dollars of the Neil Tillotson Trust and “The Balsams” hotel in Dixville Notch. The lawsuit will probably not be formally entered on the record until Monday or Tuesday due to holiday closings. A more detailed release will follow Friday.

(MANCHESTER, NEW HAMPSHIRE) (Thanksgiving, November 24, 2011)

Independent Republican Presidential Candidate Andy Martin will hold Manchester and Whitefield news conferences today, Thanksgiving morning at 9:00 A.M., Thursday, in Manchester and at noon in Whitefield, November 24th to announce he is heading to the North Country and dedicating his Thanksgiving Day to resuming his march against the Northern Pass high voltage transmission line. Andy will hold his news conference in Whitefield and then resume his march against Northern Pass.

“Thursday morning Thanksgiving Day I am delighted to announce in Manchester that I am resuming my march against Northern Pass,” Andy says. “I will resume marching at noon at the town green/center in Whitefield (the gazebo) and then march south on Route 3 towards Twin Mountain.

“I am dedicating my holiday to marching against Northern Pass because I strongly and sincerely believe the proposal is bad for New Hampshire, though Northern Pass deal-makers may enrich a handful of power brokers in Manchester, Boston and Hartford. They will also be passing out ‘peanuts’ to New Hampshire landowners.

“I note the same people who promise Northern Pass will be ‘problem free’ could not repair their existing electrical network last month and had to fire their chief executive because of service delays in Connecticut.

“But I also have some ‘tough love’ for local Northern Pass opponents. It is time for local opponents to grow up and stand up, or sit down and shut up. I have seen over the past several months an almost childlike innocence among NP opponents, as though the purity of their motives would automatically triumph over powerful economic interests and lobbyists in Washington. Even ‘Harry Potter’ knows that’s naïve. ‘It ain’t happening.’ The reality: either fight hard against Northern Pass or fry under the high voltage towers.

“Wake up, New Hampshire!

“The ‘big money’ supporting Northern Pass now has a presidential candidate who is going to support Northern Pass (more on this cash conflict in the days ahead). This candidate is drawing massive financial support for his presidential race from Northern Pass interests. Northern Pass also has a gubernatorial candidate operating inside the Northern Pass law firm in Manchester.

“Northern Pass opponents have told me they ‘don’t get involved in politics,’ and that they are ‘nonpolitical.’ But billion dollar business projects are totally political undertakings. That’s why President Barack Hussein Nobama temporarily cancelled the Midwestern Keystone XL pipeline, a proposal similar to Northern Pass generating similar controversy. Pure politics.

“To say you are not going to be vigorously involved in the political process is to confess you are forfeiting your position to corporate power brokers who will do whatever it takes to make the deal and cash in, despite the misery they inflict on ordinary Granite State citizens.

“I saw somewhere that someone wants to enlist corrupt Washington lobbyist Newton Gingrich as an opponent of NP. Gingrich will say and do anything to get votes, and he will sucker the gullible with his windbag promises before he puts his hands on his backside to collect clandestine cash and give ‘strategic advice’ to the developers of Northern Pass. That’s the way the crooked influence peddling game is played in Washington, and Gingrich is a master player. He has corralled tens of millions of dollars from special interests to promote their agendas while simultaneously pretending to speak for ordinary folks on the same subjects. Sucker.

“Fighting powerful corporations isn’t easy, isn’t cheap and takes a lot of energy and a lot of hard work and a lot of shoe leather. I know, I have successfully been fighting powerbrokers for decades. And I don’t take cash on the side to give private ‘strategic advice’ to people who are fighting the groups I am supporting in public. I am no Newton Gingrich. If people are dumb enough to fall for the Gingrich spiel and vote for a thief like him, they deserve what they get. A stab in the back.

“If people want to fight Northern Pass, they can rest assured I am not giving strategic advice to NP or its lawyers at the back door the way Gingrich does. I don’t have my hand out behind my back.

“We’ll celebrate ‘Thanksgiving’ along Route 3 as we walk down from Whitefield towards Twin Mountain. We have cold cut turkey, rolls and even a pumpkin pie.

“On this wonderful holiday my heart will be with the people of New Hampshire who would suffer if Northern Pass succeeds. The time to make decisions and take action and stop shadow boxing has arrived. I know where I stand. Where do you stand on fighting Northern Pass? Are you real, or surreal?” Andy will state at his Manchester and Whitefield news conferences.

Town Green/Center, gazebo, noon, November 24th (just before Andy resumes his march against Northern Pass)

Note: We usually try to march against the Northern Pass route in sequential segments. We ended our last marching segment in Lancaster. But we believe the road between Lancaster and Whitefield is too difficult to walk on a day when snow may be a factor. We will go back and eventually march from Lancaster to Whitefield when the weather improves. Safety first.
