Dear Attorney Nilges:
When we spoke on Monday afternoon you indicated you would call me back Tuesday morning. Since we are now well into Wednesday and you never called back, I wanted to send a brief letter to confirm my views concerning your recent conduct.
1. SLAPP activity[1]
In my lawsuit against the city I refer to SLAPP activity by the Suarez interests and their legal minions. I will confess I was somewhat amazed when you called my co-plaintiff. I am told you threatened him with a counter-lawsuit. You also apparently claimed, falsely, that our lawsuit was without merit.
Your threat to file a frivolous lawsuit to impede and inhibit citizen action against the city is independent of Suarez’ threats and independently actionable SLAPP behavior.
I can’t understand what possessed you to make such a ridiculous and self-defeating threat unless it was the improper influence of what follows in paragraph 2 below.
2. Suarez pressures
Ben Suarez is basically a paranoid bully. Corrupt lawyers and law firms such as Bill Williams put up with Suarez’ antics because he pays them well. I will be suing Suarez’ “crew” later this week. I am not intimidated by his bunch of clowns.
However, you appear to have either been intimidated or improperly influenced to make legally unfounded threats against a co-plaintiff. Suarez &
Suarez may try to force you or inveigle you into smearing me. I hope you will not do so. I walked out on Suarez when he started blackmailing his former son-in-law to expose the son-in-law’s sexual orientation.[2] That’s how far Suarez will stoop. Don’t be a sucker for Suarez.
If you treat me and my co-parties with respect, we will also litigate with you with respect. If you engage in baseless threats, you can expect genuine legal threats in return.
If you want to settle the lawsuit for our costs and fees, as well as a referendum, we are always amenable to settlement offers so long as the city vacates the unlawful ordinance and sets a referendum. If you want to bill the city to litigate, or hire outside law firms to litigate, be my guest. My clock is running too. At the end of the day the city was improperly influenced (or will your defense be sheer incompetence?) to pass an unlawful ordinance. Don’t dig yourself a deeper hole. Suarez isn’t worth it.
