(CONCORD, NH) (January 9, 2012) Independent Republican Presidential Candidate Andy Martin will hold a Concord, NH news conference Monday morning, January 9th to announce that the Superior Court for Merrimack County has set a hearing on Andy’s lawsuit to “Save The Balsams” from being sold to be dismantled. Andy filed New Hampshire “Right to Know Law” requests that were essentially ignored by the Governor and Attorney General.
“The Balsams” is the landmark New Hampshire hotel where presidential primary voting historically takes place at midnight. Monday afternoon Andy will head to The Balsams at Dixville Notch to be present for the presidential primary voting. The Balsams will only be open for voting and is otherwise closed. A copy of Andy’s letter to the law firm for The Balsams follows below.
“Hundreds of employees are losing their jobs, while the Tillotson Trust’s lawyers enrich themselves,” Andy says. “Trust assets are being maladministered. This is a major New Hampshire scandal and we are developing a permanent presence in the state to protect the public from corrupt and lackadaisical politicians who refuse to defend the public from professional predators.”

Dear Attorney Dutton:
You previously entered an appearance in my New Hampshire Supreme Court case that was dismissed by the court without prejudice to being refiled in the Superior Court. Late in 2011 the case was refiled and the Sheriff has served both the Governor and the Attorney General.
The press of a primary election is not the easiest time to pursue civil litigation but we are doing our best. However, we are working to develop a permanent public interest presence in New Hampshire to ensure that the People of New Hampshire and the People of the North Country who are beneficiaries of the Tillotson Trust are not shortchanged by the trustees, law firms and other hangers on. I have serious concerns about the mismanagement of the Tillotson Trust.
I would very much appreciate it if you would please advise me as to the following issues:
1. Will you be representing the Tillotson Trust in the current lawsuit? Although the AG and Governor are the real parties in interest in a Right-to-Know case, I named your clients as nominal parties out of an abundance of caution due to the potential ancillary relief which is being sought. Do you want to accept service and/or notice on behalf of your clients?
2. We will be issuing a stream of communications to the media concerning your clients’ apparent mismanagement and corruption and recalcitrance to make financial information available about the Tillotson Trust. I previously wrote to your client and have received no response. I am not going away.
Do you wish to be placed on a list to receive those media notices, so you may be aware of them and be prepared to respond, or would you prefer not to be emailed with copies of our media information? We have provisionally placed you on our email list, but will promptly remove you at your request.
3. We normally notify opposing parties by email with the exception of documentary exhibits. Are you willing to accept emailed notices?
4. I do not know yet if New Hampshire judges conduct telephone hearings in court cases. If they do, and a phone hearing is available for the scheduled hearing on January 18th, do you object to my being heard by phone?
5. If you have any questions, please feel free to call me. This Monday and Tuesday (January 9-10) I will be on my cell phone; normally I can be reached through my national headquarters.
While public interest litigation can become adversarial, I always endeavor to treat opposing counsel with professional courtesy and fairness as long as that approach is reciprocated. There is always the possibility we could meet Tuesday to discuss potentially narrowing the issues or trying to reach a reasonable settlement for all parties concerned. Please advise if your clients are interested in pursuing this approach.
Finally, out of an abundance of caution and professional courtesy, I would like to advise you that I will be at your client’s hotel premises for the 2012 presidential primary voting at Dixville Notch Monday evening/Tuesday morning (January 9-10).
